Calls blow to Health Care Bill “our third big victory” in campaign to turn back law
U.S. Senate candidate Jamie Radtke has hailed a Florida federal judge’s ruling Monday, which invalidated “Obamacare” due to the unconstitutionality of the individual mandate provision, as a victory and a big step in the fight against the health care legislation.
“Today’s ruling by U.S. District Judge Roger Vinson represents the third big victory in our campaign to turn back the unconstitutional health care monstrosity created by President Obama and his allies in Congress,” said Radtke.
“It was a great day when the Virginia lawsuit resulted in the ruling last December that the individual mandate is unconstitutional,” said Radtke. “Our second big victory was the vote in the House to repeal Obamacare. And now Federal Judge Vinson’s ruling moves us a step farther down the path.”
Judge Vinson’s ruling on a lawsuit filed by 26 states stated that the individual mandate is not only unconstitutional, but is not severable from the law as a whole. Therefore, Judge Vinson ruled that Obamacare is invalid.
Monday’s ruling follows the December decision on Virginia’s lawsuit, which was filed by Virginia Attorney General Ken Cuccinelli and based in large part on the Virginia Healthcare Freedom Act, a law spearheaded by Campaign for Liberty and the Virginia Tea Party Patriot Federation. Many observers expect the fate of the controversial Obama health care legislation to finally be decided in the U.S. Supreme Court, perhaps as soon as next year.
“Obamacare is an inappropriate, expensive and ineffective way to deal with the problems in our health care system,” Radtke said. “However, while America has the greatest health care system in the world, we also face challenges in this area that affect many Virginians. I want to represent Virginia in the U.S. Senate to help bring fresh thinking to the problems we face.”

Interesting, most of the countries above the US have a population less than that of California. The WHO ranking has been criticized by many because it gives a lot of weight to which countries give away health care for "free". I find it interesting that a lot of people in Europe looking for care have to come here to get it.
Don't want to pay? Don't have to but hospitals should have the right to refuse treatment. It's amazing that people in the South who are the poorest and the most unhealthy don't want to pay to have health care available. These same states are trying to or are cutting Medicare and Medicaid. But I guess it's all about getting something for nothing and let others foot the bill.

As far as people from the southern states taking advantage of the health care system, there is a very small minority that actually fit into that category. The majority of southern residents such as myself, do work for a living and take every advantage of using the health care insurance we are provided for by our employers. To make a blanket statement as you just did, only shows the pompus ignorance of so many people that live above the Mason-Dixon line and their democratic party understanding that everyone from the southern states are illiterate and lazy. There are just as many people from the northern states as theier are in the southern states that will take every opportunity to exploit others due to the fault of their own....thus people who live in glass houses shouldn't throw stones. GET MY DRIFT?
Those states are trying to cut Medicaid because OB HCB froze the cost at levels that states cannot afford. He offered a band-aid by giving States Fed (Tax) money for one year. The economy didn't improve now even NY plans on battling OB over "necessary" Cuts to health care including Medicaid. Remember the Bill also took money from the food stamp program and eliminated many State/Fed programs for the poor. Not eating is less of an option the health care coverage...
Has anybody else besides me wondered where all the people are who used to scream "activist judge!" I mean, this guy apparently tossed decades of precedent out the window by choosing to say the entire bill was unconstitutional, even though his focus was on the purchase requirement.
Is this the only article you have ever read on the the health care issue. Because the Democrats had to ram the bill through without thinking it all the way through, they worded the bill wrong. They did not include a serverability clause which means if one part is found unconstitutional, you have to throw the entire thing out. You sound like the activist and the judge followed the precedent. He's not making up anything new here.

Although the Link u show doesn't account for the millions Obama left out that will continue to use the ER (e.g. illegal immigrants). According to the dems Own investigation millions will loose coverage because of this HCB.
That is why OB is now exempting 290 large corporations from paying their share/meeting the new requirements. In the end only the American people will be responsible for the "mandatory" payments to Insurers (OB calls it a "tax").

ER visits are expected to rise. Cuts forced by the HCL will eliminate doctors and staff. The Law leaves 30 million uninsured. In the case of long term illness you still pay your health insurance(by law) in addition to the deductible- until you fall below the poverty line. This law doesn't protect sick people from loosing their homes due to illness! infact if you get sick and fall behind on your insurance payment the IRS will fine you.
I suppose it is worth observing, the 36 other country which have the socialized medical coverage ,which is apparently used as the measure of merit for this stratification, are also verging on bankruptcy.

So either way you pick up the tab. 15.4 percent were "uninsured in 2008 now there are 16.9 percent. Ironically most of those not covered, were covered by preexisting Fed or State programs they just failed to "sign up". Obama is cutting funding for those programs.
According to White House Data. Obama HCB will insure up to 32million of the 58 million not covered. That will bring us close to 2005-07 levels of uninsured.
If it unconstitutional to mandate insurance coverage, why was it constitutional to tax the public, mandatorily, under Social Security? Turned out that it is the single most successful pieces of social legislation in US history. Big business and the insurance industry along with the GOP never cared for the common man. Sad but true!

Here's a radical idea...many Democrats want to look at ways to tax the American public for heathcare subsidy and make it mandatory that they have it...right? How about making a mandate that sets a cap limit on what doctors and healthcare providers charge and make it more affordable for the less privileged to receive the care they most desperately need. And while we're at it, quit raising the cost of Medicare and Medicaid insurance or give those elderly retirees who have served us many times over a raise on what they get on the first of the month. It is a crying shame as to how we treat our elderly in this country, and this healthcare Obama is pushing up our backsides is just another way of saying that government has no idea what the people need or want. Take a look at the third world or communist block countries health care system. It is a direct reflection of what has been put into force on the American public. I fought for this country for 10 years and served proudly I might add that our freedom remains free from the dictators our fighting men and women are striving to remove as we speak. I would highly recommend anyone who lives in the United States of America and supports the Obama care system, take a look over your shoulder...you'll soon be saying...."Heil Obama".

Obama said major SS reform(cuts) are necessary to prevent default. And that the future generations should not count on SS.
Not a fan of SS.. Wish the govt. would give back all the money I've paid into the system for the last 25 years and allow me to manage it myself.. Instead by the time I'm eligible to draw on SS, everything will be gone and there will be no 'benefits' left for me..
If conservative judges and supreme court justices reverse the health care law, voted in with a supermajority in Congress, then we are no longer a democracy or a republic.

You are mistaken the govt does not force everyone to have auto insurance . you CHOOSE to drive so you must take financial responsibility. there is a difference.

Many people previously made a conscious choice NOT to pay for health insurance, that is their decision. Of course there are others that simply cannot afford it.
The Kaiser Family Foundation report shows workers now pay 47% more than they did in 2005 for family health coverage, while employers pay 20% more. Those cost are expected to dramatically increase by 2014 under the new HCB. Making matters worse is that the "mandate" reduces competition and forces you to pay whatever that cost is. Who will be in control of your HC in 2012 or at anytime in our future, Sara Palin, Dems , Republicans ? The power Obama has given future politicians to dictate your choices is alarming!!!
NH does not have auto insurance mandate! And at any time you can stop driving thus Auto insurance is not mandatory.

We are the "United States of America" my friend. Each state has the inalienable right to question the role and decisions of our government. Most of the elected officials can't even recite the Pledge of Allegiance without screwing it up! Think about what the Continental Congress stood for when we were first rid of those Red Shirt dictators back in the 18th century. Unity for the people and freedom to make our own decisions. True Obama's data may be incorrect. Sorry if it has caused confusion. A total of appox 60 million are not covered. According to OBama he will extend coverage to 32 million.
Actually if obama's health is repelled, It would be the best thing for our country. It has too much money allotted for enforcement and control of the public. Too much law and not enough health care. It is junk and unconstitutional. People on medicare already feel the cut backs and are not getting the treatments they need thanks to a "health" bill.
A good plan would be to expand medicare to cover everyone. Get rid of medicaid because it wouldn't be needed because medicare would cover everyone. Raise medicare deduction on the paychecks to pay for it. A lot cheaper than buying insurance! Those that want better coverage could buy supplemental plans as most on medicare do now. It would be so much cheaper since medicaid wouldn't have to be funded and that would take a load off of the social services. Medical charges could be standardized and would come down. The emergency room treatments (for the uninsured) now paid for by state and federal would be covered. (A lot of savings here). Just a thought. No paid I R S enforcement armies, simpler administration and management and a lot of reduction of the deficit. Plus everyone would be covered !! No exclusions. No exemptions from obama needed for friends.

Why do people say "ObamaCare" when the plan was voted in by a majority of our elected officials. Maybe if Boehner and McConnell and their ilk had cooperated the plan would be to everyone's liking and would be considered a wonderful American answer to the need to improve health care access for everyone. Just because healthcare in some other country may be substandard doesn't mean that it would have to be substandard here. People like to find objections rather than seek solutions. They like to call names rather than give credit to those who are trying to address problems.
Our Constitution calls for providing for the welfare of our citizens, and that includes health. We accept that the government has to build roads because individually we wouldn't be able to do so. The majority of our citizens owe whatever education they have to a public effort to provide education. Healthcare, like many other services, has become too expensive for individuals to handle on their own. Why not pool our resources so that everyone can have at least a minimal level of care?
