Apparently when a prosthetic eye pops out it can taint a jury. When a victim's prosthetic eye popped out on Wednesday (Feb. 6), the judge in his case declared it a mistrial. According to a report from ABC News, John Huttick was on the witness stand to testify what he has been through since losing his eye in an August 2011 fight. As he began to cry, his eye popped out, causing two jurors to gasp at what they had just witnessed.
It was then that defense attorney Eileen Hurley made a motion for a mistrial under the complaint that the jury had been tainted by the incident. Judge Robert Coleman ended up agreeing with her, stating that it was an "unfortunate, unforeseen incident." Now the trial will start up again on March 4, forcing Huttick to once again take the witness stand and talk about what led up to him losing that eye.
The alleged crime in question took place when two people got into a fight in a bar parking lot that Huttick tried to break up. Matthew Brunelli, who is the defendant in this case, then threw a bunch that hit Huttick in his left eye. It led to Brunelli getting charged with aggravated assault. At debate here is whether he simply threw a punch or actually had a metal key sticking out between his fingers that punctured the eye of Huttick. The latter argument is being made by the Assistant District Attorney.
Now everyone involved has to hope that John Huttick's prosthetic eye doesn't pop out again in the new trial.
