Prop 8 update: Stay against gay marriage will hold until December appeal

There’s no end in sight for the stay against gay marriage initially implemented following the overturning of Prop 8 last week.

The temporary stay put in place by Chief U.S. District Judge Vaughn Walker was upheld and made permanent today by a three judge panel on the U.S. 9th Circuit Court of Appeals, according to Prop 8 Trial Tracker, pending appeal of the overturn of Prop 8.

The appeal is scheduled to occur during the week of December 6, 2010. The opening brief is due September 17, 2010, the answering brief is due October 18, 2010, and the reply brief is due November 1, 2010.

    Common sense prevails; it's less complex to deal with a law which is being appealed if complications are avoided. This slam dunk decision left too many questions unanswered. Until they are answered, the decisions, whatever they are, would be continually appealed. Good decision U.S. 9th Circuit Court of Appeals -- three heads are better than one !
