Politics: Women’s legal rights, raped by law

“We have serial rapists on the reservation — that are non-Indian — because they know they can get away with it,” said Charon Asetoyer, executive director of the Native American Women’s Health Education Resource Center in Lake Andes, S.D. “Many of these cases just get dropped. Nothing happens. And they know they’re free to hurt again.”
One of the most controversial cases to cross any courts docket has been the rights of women to care for their bodies. Revolving arguments are mostly around the right to not only allow sex, but to gain an abortion should the women decide to. Yet with all the arguments we know exist out there, it still falls the individuals are being forgotten about, the central authorities are not acting in this regard. The problems may seem like they are only for a certain small percentage to deal with, but what is accepted with one will be expanded to others over time. And local events can show how this disregard goes far beyond just those in the small percentage, yet the legal process is not willing to take actions. The bigotry show by these actions is only based on the small minds which operate behind the legal offices closed doors.
We can believe our bodies belong to us, but in reality when there are too many opponents or even to much force applied, this believe is show to be wrong. It is only after such events, can we expect to find some form of justice to what has occurred, if justice is presented at all. Women have had to deal with this reality for a long time, just because we have rights and law has not stopped the actions taken against them. Laws need both to be understood and those willing to enforce them, or they present no condition upon reality. Rights are granted by laws, but without the legal support to allow these rights to be enforced or accepted, there is no real law.
Women rights are no different than any others, but if not enforced under the legal system they are not seen to exist. This is a continuing problem with many situations the legal structure is expected to consider, non-enforcement of what is already considered the correct thing. Personal biases presented by a few have become the mandates of courts, if the monetary funds are found to offer support. Mandates offered because the business of politic exchange accepts monetary funds for political favors under the guise of legal documents. All the arguing has already been done to provide enough evidence we should all be considered equal, the only problem comes from those who believe via their closed minded world they are better.
The individual is forgotten by the corrupted central authority not looking to reach out, in belief the authority is be all important. In this regard, such positions of authority gain a god-like attitude and disregard to those not seen as the same. Freedom and rights are left to be assured only by individuals taking actions, thus individuals must face off against the collective social mindset. In this fight there have been many seeking to gain back what the collective has, by misrepresentation of facts, taken away. These controversial actions should be settled by now as final decisions, but settling requires a consciences mind action with intentions not the laziness of judicial authority.
Final decisions offer even the smallest population or percentage a means of assured rights, backed all the way to where this decision was made. The complete authority and credentials of that office or person to be used in regard, thus offer the assurance and support for every individuals covered. But as the controversy over women’s rights (or the equality of anyone) continues, we are constantly reminded the centralized authorities do not act properly or with intelligence. Thus women are not protected, only able to attempt some measure of effect after they have been attacked. And this is not just seen as a disregard in the common society, it seen within the court’s more official means as well.
Legal cases over divorce proceeding, have escalations in legal conditions to bring others into the matter. The court of Judge Don Andrews has seen this with the case between the Hepworths becoming more complicated all the time. Yet forgotten are the needs of both the child and parents involved, with all the extra involvements becoming more important and taking center stage. Especially of importance, is the child needs to have a childhood, developing growth physically but also in mind, heart and soul. The importance of protecting individual’s rights has been forgotten by the desires for monetary gains in a legal industry. This continuation shows the lack of competency in the judicial system present in our society today.
The act of belief only in monetary gains has left the judicial system to simply rely upon money to determine the outcomes based on case law, no real justice gained. Legal conditions do not just happen they require the judicial system to actively engage in doing the right thing, and to direct the authoritative forces to offer support to individuals. But controversies offering more funds are what keep the legal industry going, just as every business or industry needs monetary fund to do the same. Thus as concerns are given a gain final decisions, the future litigations are closed, so are the future of funds and no industry accepts closing it doors easily. The legal industry than willingly keeps the conflicts on-going, the funds flowing to such a centralized control they operate.
