Paris Hilton, cocaine arrest, could get off (photos, video)

LAS VEGAS --  Paris Hilton is looking at being arraigned for possessing cocaine after she was arrested in Las Vegas, but lawyers says it might be a hard case to prove.

Paris Hilton's punishment, even if she were found guilty of possessing cocaine, according to Dmitry Gorin, a former .L.A. County prosecutor and defense attorney, would be some sort of drug diversion program.

“First they are going to have prove it’s her purse and then she had custody of it,” Gorin said to LA Times. “When it comes to celebrities, often assistants and entourage handle things like that, so it becomes harder to show they are the ones with the item.”

According to Radar Online, Paris Hilton has denied that the purse with the cocaine inside was hers, although the medication for asthma and $1,300 in cash were hers, according to the heiress.

When questioned about the purse, Hilton said "she had borrowed it from a friend," writes Radar Online.

Previous photographs of Paris Hilton show her holding the purse in which the cocaine was found.

In mid-July, Paris Tweeted a photograph of a purse and wrote: "Love My New Chanel Purse I Got Today :)"

Paris Hilton was stopped when police could smell what seemed like marijuana fumes coming from the car. When it was pulled over Hilton and her boyfriend Cy Waits, who was driving the car, were inside.

The couple went in to the Wynn hotel when a crowd started to gather. When Hilton asked for her lip balm from her purse, a small bag of cocaine fell out.

With regard to Hilton being convicted for this possession of cocaine, it's possible that Hilton' legal team could challenge the need for the search in the first place since Waits was not driving recklessly, reports Radar Online.

Hilton's legal team could question whether the smell was coming from Hilton's SUV in the first place.

While the police in Las Vegas say they have enough evidence to arrest Hilton for cocaine possession, they are leaving it up to prosecutors to file charges.

Radar Online has reported that the fact that Hilton was never given a blood test could be Hilton's "Get out of jail free" card. The police were remiss in not doing that.

Paris Hilton is facing a felony charge in this cocaine possession case and that carries a sentence of one to four years in prison.

    Time to really punish Paris for wrong doings. NO MORE preferential treatments. Enforce the laws on spoiled brats like her! I am sick and tired of these types wasting our tax money and time! And, she is setting a bad example to the young viewers and fans. Glad to read in the newspapers that Wynn Hotel has banned her presence there. I hope the Wynn Hotel stands firm. Paris needs to know that there are consequences to her actions. The ball is now in the court of the legal system AND the family. Her age might be high, but her behavior is very low class and childish!

    They also found Albuterol in her purse, which is an asthma treatment drug, commonly (ab)used for weight loss.

    She needs to spend some serious time in jail or prison (main population) just like anyone else would. I get sick of hearing about the little rich brat that gets by with everything and she smiles and laughs about it as though it's nothing. Why does the legal system always seem to just slap the rich people on the wrist, but throw the book on those struggling? Don't get me wrong anyone breaking the law should serve time, but they need to follow the same guidelines for all people alike!

    I really hope the Nevada legal system does n;t wimp out like Los Angelas seems to do, these people seem to think they can get away with anything.
