Orlando businessman sentenced to prison for selling popular products

Yesterday, April 29, 2014, Demis Ulises Mokay-Fong, a 31 year-old Orlando businessman, was sentenced to 19 1/2 years in federal prison. Mokay-Fong was arrested in 2013 for selling a product Americans desired and for illegally re-entering the United States after he had previously been deported.

On November 21, 2013 Mokay-Fong pleaded guilty in federal court for selling the products, which are currently illegal in the United States. Mokay-Fong distributed over 11,000 pounds of marijuana utilizing tractor-trailers, 12 pounds of methamphetamine and a few kilograms of cocaine. Mokay-Fong was a distributor of the popular products he obtained from Mexico and distributed in the Orlando-metro area.

The federal government chose to charge and convict Mokay-Fong for distributing the popular products rather than more serious charges. The federal government had evidence Mokay-Fong utilized 'hit men' and kidnapped family members in order to collect overdue accounts receivables. The federal government chose to convict of Mokay-Fong of acts that were voluntary transactions, rather than acts of violence and assault.

Mokay-Fong’s business partners were previously sentenced for their roles in the distribution business. Carlos Armando Castro-Medina was sentenced to 13 years, Irvin Gutierrez, was sentenced to six years and Jesus Emmanuel Corrales was sentenced to three years in prison.

Libertarians do not believe such a circumstance should have taken place and the federal government is expending precious few resources on the failed War on Drugs. The Libertarian Party, through a statement in 2011 said, ""America's first experiment in prohibition involved alcohol, and is widely recognized as a failure. Approved in 1919, Prohibition I led to a steady rise in both alcohol usage and violent crime. The murder rate rose 50% between 1919 and 1933, peaking at 9.7 murders per 100,000 population in 1933, when the country finally decided enough was enough. Immediately after the repeal of Prohibition I, gangsterism went into a swift decline, with all of the major gangs disappearing within 18 months, and the murder rate dropping every single year for more than a decade."

In Florida, the state which Mokay-Fong was sentenced in federal court, will likely legalize marijuana possession and sales in some form this year. It is likely to be legal in a highly restrictive form should Florida Governor Rick Scott sign it into law. There is a more expansive medical marijuana referendum that will be on the November, 2014 ballot for Florida voters to decide.

The Libertarian Party's platform states:

"Libertarians want all members of society to have abundant opportunities to achieve economic success. A free and competitive market allocates resources in the most efficient manner. Each person has the right to offer goods and services to others on the free market. The only proper role of government in the economic realm is to protect property rights, adjudicate disputes, and provide a legal framework in which voluntary trade is protected. All efforts by government to redistribute wealth, or to control or manage trade, are improper in a free society."
