Obama violated the Constitution according to the court. On Jan. 25, Yahoo! News reported that the President bypassed the Senate when he appointed three members of the National Labor Relations Board. The vacancies were filled on Jan. 4, 2012 when Congress was still on holiday break. This decision could invalidate hundreds of appointments over the past year.
"The decision of the U.S. Court of Appeals for the D.C. Circuit marked a victory for Republicans and business groups critical of the labor board. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize," reports Yahoo! News.
If Obama violates the Constitution, the decisions that he made in doing so would not stand. He would not face any other consequences, at least in this instance. Obama supporters would agree that the President didn't do anything wrong. However, those who don't like Obama or approve of his positions agree that he is in direct violation here, regardless of the White House's attempts to defend his decision.
Another interesting tidbit is that "Obama made the recess appointments after Senate Republicans blocked his choices for an agency they contended was biased in favor of unions," Yahoo! News reports. Whether or not this is a "coincidence" is still uncertain.
