Obama admin does something right, some proposed FDA restrictions are dropped

Yesterday, June 24, 2014, the White House Office of Management and Budget (OMB) have lowered the health risk rhetoric and proposed rules for e-cigarettes and cigars. The OMB announced it is deleting language from the FDA's proposed regulations they made in April, however no final rules have been implemented as the FDA will not complete its public comment period until August 8, 2014.

The OMB rule change would still restrict vending machine sales, however leaves open the ability to purchase tobacco products, including e-cigarettes, online. Another change would put cigars into two classifications, one for premium cigars and another for all the others. The OMB also deleted the FDA's claim as to how many lives would be saved by their regulation of the cigar industry. Also deleted was an analysis was how American's health would improved due to their slapping a warning label on the cigars.

In December, 2013, 24 Republican members of Congress asked the agency to exempt premium cigars. An excerpt of their letter stated, "As you know premium cigars are a niche product with an adult consumer base, much like fine wines. The majority of people who enjoy a cigar do so occasionally, often in social or celebratory settings."

OMB also has deleted language in which the FDA attempted to regulation the manufacture of e-cigarette cartridges and what chemicals they contain. Most Libertarians would be for disclosure of what chemicals Americans are ingesting into their bodies, however that would be the limit of regulation for most Libertarians. The FDA wanted the ability to inspect the quality of various e-cigarettes and their cartridges before they reached the market, however under the new OMB draft, it would appear that may not be happening. The FDA wanted to regulate quality control, nicotine content and eliminate toxic ingredients found in some e-cigarettes, like diethylene glycole (found in cough syrup and acetaminophen).
