Nonprofit will petition Colorado Supreme Court over Denver parks issue

The Colorado Court of Appeals has affirmed a Denver district court judge’s decision, but that won’t stop a nonprofit from seeking justice from a higher court, the attorney for Friends of Denver Parks announced Monday, December 30.

Attorney John Case is preparing to petition the Colorado Supreme Court.

Friends of Denver Parks also will proceed with a scheduled district court jury trial in May over a park land swap between the city of Denver and Denver Public Schools. The nonprofit also will launch a ballot initiative to confer official park status on “the numerous parks in Denver that the city has neglected to designate by ordinance,” Case wrote.

The issue arose over a secret land swap between the city of Denver and Denver Public Schools involving most of Hampden Heights North Park in southeast Denver.

Supporters of the nonprofit include the Rocky Mountain chapter of the Sierra Club, Denver Inter-Neighborhood Cooperation and former Denver mayor Wellington Webb.

Case is a partner in the Denver law firm, Benson & Case LLP. He is acting as the nonprofit’s pro bono legal counsel.
