A mom from Port St. Lucie, Florida, has been arrested and is facing a charge of child neglect for allowing her seven-year-old son to walk to the park by himself. Fox 6 Now reported on July 29, 2014, that Nicole Gainey said her child is old enough to walk to the park alone but the Port St. Lucie Police disagree with her, and now it's caused a battle.
This past Saturday, seven-year-old Dominic Guerrisi asked his mother for permission to walk to the park near their home. She allowed her son to go to the park, and he carried along his cell phone in case of an emergency.
“Honestly didn’t think I was doing anything wrong,” says Gainey, “I was letting him go play."
The park that Nicole Gainey allowed her son walk to is just a half mile from their Port St. Lucie home, and it usually takes him 10-15 minutes to walk there.
WPTV reported that the trouble started when Dominic walked past a public pool on his way to the park. Someone at the pool asked him where his parents were.
“They asked me a couple questions and I got scared so I ran off to the park and they called the cops,” says Dominic.
Dominic ended up making his way to the park and began playing. It was then that the police showed up and asked him where his mom lived before taking him home. Upon arriving at their home, the police arrested Nicole Gainey and charged her with child neglect.
She paid close to $4,000 to bond out.
One of the police officers wrote in their report that Dominic was unsupervised while at the park and that "numerous sex offenders reside in the vicinity."
Gainey said that she believes Dominic is mature enough to go to the park by himself during the day. She said that she also calls him regularly on the cell phone to check on him.
She has all intentions of fighting the felony charge against her, and she doesn't plan on allowing Dominic to go to the park alone anymore. It isn't because she is scared of what might happen to him, but because she doesn't want to be arrested again.
