A New Smyrna Beach man was killed in a Volusia County traffic accident Saturday night, according to the Florida Highway Patrol. FHP spokesperson Sgt. Kim Montes says 37-year old David Legler was thrown from a vehicle in the accident at Samsula Drive and Strawberry Lane around 11:20 p.m. Saturday. Troopers say the driver of the car, a 48-year old New Smyrna Beach woman, lost control of the car for an unknown reason as it was southbound on Samsula Drive. The car travelled from the southbound lane, across the northbound lane and then onto the east shoulder of the road. The FHP says the car then went into a ditch, hit a concrete culvert, and flipped end over end, landing on its roof. Troopers say Legler was not wearing a seat belt in the right front passenger seat and was thrown from the car. He was later pronounced dead at the scene. The driver of the car was treated for minor injuries at Halifax Hospital in Daytona Beach. The FHP says charges in the case are pending.
