NC man charged with statutory rape with a minor under the age of consent

An East Flat Rock, North Carolina man is in jail after being charged with having sex with a minor, Fox Carolina reported March 13.

Thomas Mills, 22, was charged with statutory rape with a minor under the age of consent. The incident reportedly took place March 1. Mills was arrested by Henderson County Sheriff's Office deputies this afternoon, and is being held on $80,000 secured bond.

Mills is scheduled to appear in the Henderson County District Court Friday morning at 9 a.m.

Statutory rape punishment depends on the age of the victim, as well as the age of the person convicted. Penalties are stronger is the person who committed the rape is more than six years older than the victim than if the age difference is four years or less.

The defendant being misled about the victims age is not a defense, and consent can not be used as a defense when the victim is under the age of 15.
