Montgomery County is continuing to issue same safe couples marriage licenses. The county has come under fire for the legality of the marriage licenses but acknowledge today that the county has not taken any steps to stop the issuance of said license. A phone call today to the neighboring Delaware County Register of Wills who issues marriage licenses, was informed there would not be any same sex marriage licenses issued and declined to give a reason why. In Montgomery County over 100 marriage licenses have been issued. In the coming weeks though, the licenses could be ruled invalid if the court challenge validates the Defense of Marriage that argues that marriage is between a man and a woman. D. Bruce Hanes, the electoral register of wills in Montgomery County has stated that his office and the solicitor for the county reviewed the state constitution and they concluded that it would be a civil rights violation not to issue the marriage licenses.
Another road block for same sex couples are whether the marriage certificate will be recognized by the Commonwealth of Pennsylvania. In New York, their marriage would be valid but in New Jersey that state only recognizes civil unions. How Pennsylvania will recognize these same sex marriages will depend on the outcome of the hearing that will decide whether the Defense of Marriage Act is not a violation of the civil rights of these couples.
