U.S. Supreme Court Justice Antonin Scalia is one of the reasons that we have a Bill of Rights. To protect us against people like him. See, the Founding Fathers knew there would be people like Scalia in positions of power. People like Scalia who view Americans with a limited degree of liberty and rights. People who believed it was fine for the government to ban contraceptives, ban interracial marriages and lock up gay men for their consensual sex lives. The Constitution and the Bill of Rights don't express a limited or narrow degree of rights, but a broad degree of liberty. Indeed, the 9th Amendment guarantees rights not listed explictly in the Constitution.
I bring this up because Justice Scalia stated in a speech: "Homosexual sodomy? Come on. For 200 years [including at the time of the Fourteenth Amendment], it was criminal in every state." I believe that Justice Scalia tailors his opinions to his beliefs, though he would deny it. He is what those on the left on our courts are often accused of being, a judicial activist. He wants the government promoting religion to some degree, such as clergy led prayer at school events. So, when he opposes the right not to have the government persecute you for your sex life, he is not only speaking as a judge of the law, but someone opposed to gay rights.
Republican presidential candidate Mitt Romney wants more justices on the courts like Scalia, it is up to stop him from being able to do so.
