Mary Hayashi sentenced to three years probation

Assemblywoman Mary Hayashi entered a plea of  "no contest" late Friday to a misdamenor shoplifting charge and was sentenced to three years of "court probation." It is expected that this ruling will not impede her current ability to serve in the Assembly. Her first plea entered after being arrested and charged last Fall was "not guilty."

Hayashi, 45, was stopped by a security guard on October 25, 2011 shortly after exiting the Nieman Marcus store at Union Square in San Francisco. This particular outlet is located at 150 Stockton Street. At that time she was found to have a pair of leather pants, a black skirt and white blouse on her person. Shortly thereafter, bail of $15K was posted and she was released.

The merchandise had a retail value of $2,445.

Hayashi serves in Alameda County which covers Pleasanton, Hayward, Dublin and Castro Valley serving in this capacity since 2006. She is married to Alameda County Superior Court Judge Dennis Hayashi who has served in that position since his election since 2008.

It has been recently reported to prosecutors that Ms. Hayashi has been undergoing successful treatment for a benign brain tumor that will no longer impede her decision making ability. At the time of her initial detainment, Hayashi was reported to have a cellular phone pressed to each ear having two simultaneous conversations while walking out of the store.

Hayashi was also court ordered to pay the amount of $180.00 in court fines and fees.
