Mark Davis a victim of judicial tyranny in Alabama

On September 17, Mark Davis was unjustly sentenced to life in the Lauderdale County Detention Center. This aberrant ruling was made by Lauderdale Circuit Court Judge Michael T. Jones. Mr. Davis received a sentence of 60 days for 60 counts of criminal contempt . He was to accrue an additional count of contempt for each day he was jailed and unable to comply with the court order- a virtual life sentence.

Mr. Davis was given two weeks to provide evidence he supported and provided for his daughter. Davis being a capable father, produced on such short notice $16,000 in receipts and $8,000 in expenditures. He was obviously innocent of the charges of criminal contempt. Obvious to everyone but Judge Jones, who exercised what can only be called willful negligence and/or judicial incompetence. These alone are grounds for impeachment per Alabama State Code, Title 36, Chapter 11.

What pray tell was the heinous crime that warranted such drastic sentence? Mr Davis was sentenced to life for a child support case. He worked with the Alabama Family Rights Association (find them on Facebook), which dared question the disappearance of millions of dollars in federal funds under the helm of former Chief Justice Sue Bell Cobb. With Judge Jones being precluded from hearing the issue of contempt much less partaking in his sentencing per Alabama Criminal Rules of Contempt; Davis' dilemma reeks of judicial vindictiveness.

Justice has been put on the back burner to protect a federal taxpayer funded cash cow. This revenue comes in the form of funds based on the amount of child support collected. This money then finds it's way to judges, state attorneys, and Human Resource employees. In their effort to demonize and vilify Mark Davis these forces trampled upon:

  • Rule 70A Alabama Rules of Criminal Procedure.
  • Alabama case law.
  • The Due Process Clause of the Alabama Constitution.
  • The 14th Amendment to the U.S. Constitution.

Judge Jones was presented with the receipts showing Mr. Davis covered his daughter's braces, activities, summer camps, school lunches, etc... Judge Jones refused to give him credit these fatherly duties. He even went as far as saying that Mr. Davis "...is due no credit for any amounts...paid for the benefit of the child..."

In what can only be described as a clear abuse of power; Judge Jones charged him 12% interest on past due child support. The Department of Human Resources in Alabama is limited to 7.5% per law. Mark Davis was also ordered to pay for day care by Judge Jones. Another deviation from reality since Davis' daughter was 12 and in school. Don't confuse them with the facts.

This was never about child support, but rather creeping judicial overreach, denied due process, political racketeering, fraud, and abuse of power. It's about a father and daughter being torn apart. It's about corruption in the halls of power in Alabama. It's about an old boy network that goes above and beyond to protect their own. It was about Mark davis being taught a lesson.

There are currently over 40,000 children being deprived a relationship with both of their parents. Enough is enough of misguided bureaucrats profiting from the suffering of innocents. The citizens of Alabama can and must put an end to this judicial tyranny.

On Thursday, October 10; funds were raised by supporters to pay the frivolous back child support and free Mark Davis. He was supported by average Alabamians fed up with seeing good people trampled underfoot by out of control government.

Mr. Davis sued a Lauderdale Circuit Court Judge, District Attorney Connolly, and several state agency employees in federal court. His predicament reeks of retaliation. From the halls of power in Washington, DC to Alabama abuse of power and corruption has spread like a malignant cancer. It must be met with resistance from freedom loving Alabamians.

We as citizens can make a difference. Silence in the face of such abuse of power is consent. Stand today and make your voices heard not only for Mark Davis, but for decency, justice, and common sense in Alabama. Justice can and will prevail in Alabama. It will take an awakening among Alabamians armed with knowledge and a desire to see truth triumphant.
