According to the Charleston Gazette reported on Feb.26, a man from Maine whistles so loud that not only can he be heard a block away but he actually got arrested for it and charged with disorderly conduct. Apparently, he was disturbing businesses and they called the police on him. He has been cited twice in the last year for his loud and disturbing whistling.
Although he was charged with disorderly conduct for the loud whistling, he has reached a deal with the city where he can whistle but he is not to stay in one spot. He has to keep moving while he whistles.
Businesses have complained that he is a never ending noise maker because of his loud whistling and he is disturbing their business and customers.
The Maine man, 32 year old Robert Smith, is a construction worker during the summer time but when there is no work he likes to take a bus to downtown Westbrook and walk the streets from 9 am to 5 pm while wearing sunglasses and listening to music with his headphones. While walking the streets and whistling, some smile and say hello while others frown with disgust and pass him by with irritation.
He pleaded guilty to the disorderly conduct charge but made a deal with the city that as long as he walks and whistles and doesn't just stand around that there is nothing they can do to him and they will leave him alone.
The prosecutor on the case said Smith is protected by the First Amendment. However, she and the judge both see it as a behavioral issue since he does follow those people who give him a 'wrong' look.
