A man from Louisiana claims that an ex-girlfriend stole his sperm and then had his child without his knowledge or permission. He is suing both the ex-girlfriend and the sperm bank.
Layne Hardin filed the lawsuit in Harris County, Texas against the Obstetrical and Gynecological Associates’ sperm bank for failing to protect his DNA from being stolen. Hardin made the sperm deposit in 2002 with yet another ex-girlfriend, Katherine LeBlanc.
Hardin and LeBlanc signed the original contract in 2002 with Texas Andrology Services. According to the contract, LeBlanc was supposed to be the only one with access to his sperm.
Hardin claims that he then began dating Toby Devall and when they broke up, she “made a withdrawal” from his sperm bank account without permission. According to Harden’s attorney, the sperm bank handed Devall his sperm “with no questions asked.”
Devall gave birth to a son now two from the stolen sperm. Devall’s attorney spoke with KHOU and stated that genetic tests show the little boy is Hardin’s son.
Once he heard about the child, Hardin became concerned that he could be held responsible for child support. However, the child support isn’t the worst part.
Hardin stated, “It don’t stop when he’s 18. This is forever. This ripple effect affected me and my family. When he gets old enough and realizes how he was brought into this world, then his ripple effects starts.”
