Lindsay Lohan is scheduled to be in court in Wednesday, but she's not going to be. TMZ learned on Tuesday that the troubled actress, who was ordered by a judge to appear on Jan. 30 for a hearing on her charges of lying to the police, claims she is sick, and thus can't attend the hearing.
Her new lawyer, Mark Heller, has submitted documents notifying the judge that Lohan will not be in attendance due to her illness. The note, from a Park Avenue physician, says that Lohan has an upper respiratory infection and can't fly, both for her own safety as well as the safety of the general public.
It is unclear if that excuse will fly (pun intended). However, in addition to the physician's note, Heller provided an article from the New York Post dated Jan. 11, reporting that a flu epidemic has hit New York City.
However, TMZ had a number of pictures showing Lohan partaking of an all-day shopping spree in SoHo in New York City on Saturday. While you might wonder why that is relevant, that's the same day the doctor allegedly examined her. Yet, not only was she shopping up a storm, she was also seen smoking, which would seem to be ill-advised if she has a respiratory infection.
Lindsay Lohan recently dumped her long-time lawyer, Shawn Holley. She hired Mark Heller, a New York lawyer not licensed to practice in California, instead. It's unclear why, but the question of money has been raised.
Lohan apparently owes Holley $300,000 and hasn't paid her in six months; Heller may even be taking her case gratis, for the publicity. Heller still needs to get approval to represent her.
On the other hand, it's unclear that Lohan is in trouble as TMZ posits. After all, unless the judge is reading this article, how would he know about her antics? It's unclear that the evidence is admissible (in court), either.
