Lindsay Lohan is being arraigned today on charges that she lied to the police. Those charges could lead to up to months in jail; in addition, her probation on her jewelry theft case has already been revoked.
Reports early Tuesday, Jan. 15, the same day as the hearing, say that Lohan could have avoided jail time -- now reported to be almost certain -- if she had done one thing. That would have been to not fire her longtime lawyer, Shawn Holley, on Monday, no less.
Not only had Holley managed to keep Lohan from doing serious jail time through all these years, she was reportedly -- literally -- on the way to the courthouse to negotiate a deal that would have saved her from jail in exchange for lockdown rehab.
The Santa Monica City Attorney, who is prosecuting Lohan for allegedly lying to police after her June car crash on Pacific Coast Highway, was willing keep make such a deal, provided the troubled actress agreed to check into lockdown rehab for six months.
In addition to jail time for those charges, Lohan also faces jail time for the revoked probation mentioned above, for her jewelry theft case. Sources said that the judge might have agreed to the deal covering both cases.
Holley, however, was fired, and it looks like it was over money. Rumors are that her new lawyer may be taking the case gratis, strictly for publicity purposes. Mark Heller was suspended from practicing law for five years, back in the '90s.
Lohan now says she wants Holley back, perhaps after friends reminder her how well Holley has performed for her. Holley will probably show up today, sources say, at the 8:30 a.m. hearing as she is still counsel of record. What happens afterwards is still up in the air.
