E! is reporting that Judge Stephanie Sautner has received notice today that Lindsay Lohan will not be able to make her hearing scheduled for Wednesday due to the flu.
Apparently the troubled 26 year-old is in New York, and based on doctor’s orders, unable to fly to the hearing in California.
Earlier this month Lohan's attorney Shawn Holley appeared in court to enter a not guilty plea to probation violations stemming from a June car crash. Just prior to her appearance Lohan, in an untimely move, fired Holley, ultimately having to beg her to stay on and help with these new charges.
Holley has been with Lindsay through all her trials and tribulations, as they have played out in the courtroom as well as the media over the years.
Lohan has been charged with three misdemeanors: obstruction, providing false information to an officer and driving with wanton disregard.
The beleaguered actress had rejected a plea bargain which would have landed her in rehab, keeping her out of jail. The move comes as a surprise because of the seriousness of the charges coupled with her probation.
Lohan remains on probation for her 2011 jewelry shoplifting case. If convicted she could be facing a long prison sentence. Most observers believe she should have taken the plea deal to avoid jail time.
Her probation violation case was transferred to Judge Sautner, who happened to be the presiding judge in her shoplifting case. Her trial date is scheduled for Feb. 27.
