Lindsay Lohan scandal news! The assault case filed against the actress in New York City is falling apart. On Jan. 7, 2013, the Hollywood actress failed to appear at a New York court hearing. Lilo was arrested for allegedly punching a married female -- a Florida tourist -- in the face at a swanky night club. However, US Weekly reports there may be a credible new witness that has emerged who says the wayward Disney princess did no wrong -- causing prosecutors to pull back on the case.
Lohan was set to appear in court to face a misdemeanor assault charge for allegedly punching Palm Beach psychic Tiffany Mitchell during an altercation at Avenue nightclub on Nov. 29.
According to Heller, however, the defense team has since drawn up some "very credible evidence and testimony" that would weaken Mitchell's case, including a statement from a witness that Lohan "did absolutely nothing wrong [and] had made no contact with the alleged victim."
Lohan caught an inordinate amount of grief from the woman -- an alleged psychic who failed to see the punch in the face coming if she hassled the actress while she was partying at a night club. The group Lindsay was at the club with included several friends and her sister.
The Hollywood celeb says she was just hanging out and trying to have a good time. She was in New York City to see the Justin Bieber concert and one of his opening acts The Wanted. Since she has a boy band crush on one of the band members, Lohan was likely to have been on her best behavior that evening, even if that meant she was a little high-strung.
Mitchell and her posse ( a group Lohan herself described as "Gypsies") allegedly approached Lohan trying to get her to buy a psychic reading. But Lilo says that the woman and her friends actually stole her sister's purse and the $10,000 in cash that was in it. While they were trying to hustle her, the robbery allegedly took place.
But police in New York City failed to believe Lohan at the time of the crime because she fled the scene. Mitchell claims Lohan punched her in the face while yelling racial slurs at her, but really – – it sounds as if Lohan tried to avoid nasty celebrity scandal by leaving.
Because the new witness has emerged, prosecutors have elected to postpone the case while they complete their investigation of the alleged crime. Fox News says:
But Lohan's absence (she was not compelled to attend) was of little significance as the misdemeanor assault hearing was postponed.
Attorney Mark Jay Heller spoke to reporters after signing paperwork at the courthouse Monday and predicted the charges stemming from a nightclub altercation would eventually be dropped.
At the time of her arrest, Heller said Lohan was "a victim of someone trying to capture their 15 minutes of fame."
