Lindsay Lohan is refusing a plea deal to enter rehab and will take her chances in court, according to a Radar Online report on Jan. 23. Sources told the website, exclusively, the plea bargain would place the “Liz & Dick” star in rehab for nine months in lieu of possible jail time.
Lohan is facing criminal charges related to a car accident last summer. The actress was on probation for 2011 jewelry theft conviction when she slammed her car into a truck in Santa Monica, Calif. Lohan is accused of lying to police when she told them she was not driving the vehicle at the time.
The former Disney star is reportedly refusing the plea deal and will go to trial. Lohan fired her high- profile L.A. lawyer Shawn Holley and is now represented by New York attorney Mark Heller.
“Mark believes he can get Lindsay acquitted of all criminal charges stemming from her car accident in Santa Monica last summer,” says a source. “Lindsay has convinced Mark that she never lied to cops when they asked her if she was driving the car that day.”
It appears that Lohan is quite confident that she can prevail in court if the judge objects to a reduced stint in rehab. An insider told the website, “There was a plea bargain offer on the table for Lindsay to go to rehab for nine months, but she absolutely refused that. Mark won’t sign off on a deal that sends Lindsay to rehab for more than 60 days.”
The insider continued, “Lindsay has made it clear to Mark that she won’t be going back to jail, or to rehab under terms that she doesn’t agree to but it doesn’t appear that Lindsay comprehends the huge legal gamble she is taking by going to trial.”
Lohan is set to appear in court on Jan. 30.
