In an effort to protect the Second Amendment rights of citizens of Kansas, the Libertarian Party of Kansas has filed suit against Leawood, Lenexa, Prairie Village and Kansas City. The lawsuit is aimed at ordinances in the aforementioned municipalities which prohibit the open carry of firearms, blatantly contradicting Kansas state law. According to Kansas Statute 12-16 124:
(a) No city or county shall adopt any ordinance, resolution or regulation, and no agent of any city or county shall take any administrative action, governing the purchase, transfer, ownership, storage or transporting of firearms or ammunition, or any component or combination thereof. Except as provided in subsection (b) and subsection (a) of K.S.A. 2009 Supp. 75-7c11, and amendments thereto, any such ordinance, resolution or regulation adopted prior to the effective date of this 2007 act shall be null and void.
The Libertarian Party of Kansas has been going after unconstitutional gun ordinances for almost a year, and several municipalities have already changed their laws to comply with the Kansas statute providing for the right to carry openly:
In February, 2012, the Libertarian Party of Kansas began publicly challenging the unconstitutional bans of the open-carry of firearms in Overland Park, KCK, and other municipalities in Kansas. Some communities, like Overland Park, Gardner, and Wichita have already acted by amending their ordinances to comply with state and federal law. Some communities, like KCK, Leawood, and Prairie Village have indicated they have no intention of complying with the law unless they are forced to do so by the Courts.
