When the people of Oklahoma voted to amend the Oklahoma State Constitution to forbid the use of Sharia Law in their courts, one liberal judge overturned the will of the people as if she and she alone had the power of an overlord ruling the state. In doing so, she note only violated the state constitution, but the Constitution of the United States. Specifically, she violated Amendment XI which states;
U.S. Constitution Amendment XI
The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.
What this means is that if someone from California moved to Texas and tried to sue someone, or even the state itself, for something based on California law and not Texas law, that case would be thrown out. It also includes foreign laws saying that they cannot be used in state courts. Citizens from other countries cannot use their laws in American courts.
Yet some Oklahoma judges have been doing just that, as have judges in other states trying to accommodate Moslem immigrants. America was not founded on Sharia Law, nor on any part of it. Sharia is known worldwide as the most oppressive set of laws similar to the laws of despots. For this judge to say that Sharia Law can be used in Oklahoma courts is not just a violation of state’s rights, it is a violation of the Constitution.
