Leaked DHS memo details amnesty without Congress involvement

A newly leaked amnesty-memo inside Department of Homeland Security reveals a way to grant amnesty without Congress debating comprehensive immigration reform or casting a vote.

This is the third inside memo to be leaked to the media regarding the Obama Administration’s intent to legalize 20 million illegal aliens currently residing in America unlawfully. The first memos came out of Immigration and Customs Enforcement (ICE) and U.S. Citizenship and Immigration Services (USCIS) agencies- both put together likely tools that could be used to make an amnesty end run around lawmakers.

The American Spectator recovered the latest document from DHS and reports some dubious plans that insiders say went all the way up to the DHS Secretary Janet Napolitano.


“If going forward with a larger registration program is not possible,” the memo reads, “we could propose a narrowly-tailored registration program for individuals eligible for relief under the DREAM Act, AgJOBS, or other specifically designed subcategories.”


For those who don’t believe the Obama Administration’s intensions about back-door amnesty language contained in the DREAM Act asks for targeted amnesty for children under the age of 35 who attend college or join the armed services. The kicker with the DREAM Act is the Democratic leadership is placing this legislation inside a defense spending bill set to hit the Senate floor next week.


Included in the DHS memo are details about political ramifications of a backdoor amnesty push. The memo outlines a beginning phase that would legalize illegal immigrants through DHS without comprehensive immigration legislation. The DHS memo also reads that by "using administrative measures to sidestep the current state of Congressional gridlock and inertia," would move the new policy forward by documenting those here illegally.


Measures DHS would implement include registering, fingerprinting, and screening the illegal immigrant population-excluding those illegal aliens who have committed a felony- but DHS envisions handing out eligible illegal immigrants work permits, a process that would lead to their legal status.


However, the memo acknowledges that sometime down the road Congress would have to pass legislation to extend permanent legal residence.


This newly recovered memo is consistent with inside memos from the USCIS and ICE, a key difference is the concern about Congress’ reaction to being circumvented. “The Secretary would face criticism that she is abdicating her charge to enforce the immigration laws. Internal complaints of this type from career DHS officers are likely and may also be used in the press to bolster the criticism.”


In fact the USCIS has been looking for ways to grant amnesty without Congress for sometime and their memo outlined the method of skirting lawmakers. According to USCIS some illegal aliens would be granted resident status by simply handing them “green cards.”


“In the absence of Comprehensive Immigration Reform, CIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations,” the memo read, two of the four who wrote the controversial memo were President Obama appointees including the head of USCIS Alejandro N. Mayorkas.

    Leave it to Kimberly to find this stuff and make us aware of it. Thanks Kim, you rock. Osama Barak can't be as above board about stabbing Americans in the back on this issue as his predesessor, Bush was. The ruling class knows exactly how much the American citizens do NOT want amnesty given to illegaql aliens. And it certainly would help if the people of AZ would put our nataion of their crooked political party and vote for ANY candidate who is NOT John McAmnesty.

    We have GOT to stop this!!!! We can start by blocking the Dream Act as part of the Defense Bill! Dreamers are always playing victim, saying that, "...though no fault of their own." This isn't good enough! They have taken advantage of a k-12 free, with breakfast and lunch! Enough for people who shouldn't be here in the first place!

    Also, what about our American foster children who age out and are dumped after reaching 18...with nothing...THROUGH NO FAULT OF THEIR OWN. Let's bring attention to our citizen children, who, through no fault of their own..." Dream Act is another back door amnesty and a way for them to bring others over. Don't be duped by the sob stories that are paraded before the camera.

    1. You left the word "legal" off your heart warming story about immigrants building this country. 2. NO, everyone does NOT deserve a chance to live the American Dream. You earn it through legal immigration, assimilation into our society by learning our language, our history and our government and becoming a United States citizen; not by sneaking in and popping out a couple of anchor babies then declaring yourself a citizen. Got it?
    P.S. There is no record of the usurper that is squatting in the WH ever renouncing his Indonesian citizenship and becoming an American. Put that is your hash pipe and smoke it!

    The word you forgot was "illegal" immigrants. None of us are against legal immigration, and I have 2 daughter-in-laws trying to gain legal immigration status. It is outrageously expensive! And, yet, we should grant legal status to people who've climbed over the 'fence' illegally? Who terrorize our communities, take our money out of the country, send weapons back to their family in the south to come across the border and deal with border patrol successfully? What part of the term "illegal" do you NOT understand?

    I hope legal Americans are outraged at the lengths of deception and back-room deals that Oshama and his administration will go to in order to let 20 million criminals walk free, with the ultimate reward of citizenship for all their crimes. The sneakiness of this administration is totally insane and we the people must speak out to our reps and Senators so that this stops now. Americans should go crazy if illegals get a free pass, whether it be the DREAM Act, AgJobs or whatever. It is a shame that this president will not enforce our laws and go out of his way to help the criminals continue their crimes. I will not vote for any candidate who supports amnesty or illegals. Anarchy if the admin back-doors an amnesty with Congress support.

    The non-enforcement policy for illegal aliens who don't commit (or or not prosecuted) for violent felonies is now being codified in the directives by DHS to DHS employees. For example, the dropping of thousands of deportation cases. This IS the administrative amnesty being put into effect. I'm not a lawyer, but how is this possible that DHS could have this much administrative leeway not to enforce existing laws? Is there a dereliction of duty accusation that would have legal weight that could be thrown at them?? Just wondering.

    Obama is the villian de jour. The two-party merry-go-round turns so slowly that most people don't realize they are going in circles. Blatant malfeasance is the travel brochure. Remember Asa Hutchinson? This was George W. Bush's whipping boy, who was constantly under fire for non-enforcement of immigration laws. In Clinton's final year in office, over 1200 illegal employers were popped. In Bush's first year in office, that number dropped to less than 12, and the furor was over southern California Wal Mart who got a slap on the wrist for hiring illegals. Bush continued his treasonous non-enforcement for eight years. Malfeasance? You bet ya! But then, of course, congress was controlled by Republicans. The parchment on which the Secure Fence Act of 2006 was written was used as toilet paper.

    Now we have Obama and his "whipette" Janet Napolitaco pulling the same crap, but of course now congress is controlled by the Democrats. Get the picture? America is dining from a menu of two - cheap labor or cheap votes. Is it impossible to exit the two party merry-go-round? I certainly think so. If the country believes they are going to Tea Party their way out of this, they're crazy. The Republican / Democrat strangle hold has lasted for decades. Like it or not, breaking this cycle can only be acheived with violent physical force, NOT at the ballot box. But not to worry. Americans have been transformed into limp-wristed narcistic drones, whose drive in life is laying claim to the next big electronic gadget before their neighbor does. Perhaps it is all for the better that the spirit of America has been broken, disabled, and splintered. Just enjoy the merry-go-round and remember to take your Dramamine.

    USCIS and DHS need to be shut down when the new Congress comes to power in late January. The ICE Enforcement arm of DHS can be transferred to the FBI. I believe that's the way to go. The bureaucrats will be looking for work. The EOIR in USCIS is also a joke. No more "politicizing" from the Chief! It must be an ENFORCEMENT-ONLY agency!
