Lawsuit against ‘GTA 5’ publisher Take-Two over ‘GTA Online’ claims dismissed

A class-action lawsuit that alleged that Grand Theft Auto 5 publisher Take-Two Interactive and its subsidiary Rockstar Games had misled consumers to believe that the multiplayer component of the game GTA Online would be available immediately has been dismissed by a U.S. District Court Judge, according to a report today from VG 24/7.

Reported first by Game Politics, the lawsuit claimed that Take-Two and Rockstar falsely advertised that the online multiplayer component of GTA 5 would be “available immediately,” and as it did not launch until a month after the game’s initial release that the publisher perpetrated “unlawful,” “unfair,” or “fraudulent” business practices.

However, U.S. district Court judge Virginia A. Phillips thought differently, and granted Take-Two’s motion to dismiss the case, saying that no where on the game’s packaging did Rockstar or Take-Two specific that GTA Online would be available “immediately.”

Phillips also noted that disclaimers on the GTA 5 packaging warned consumers that online features and gameplay “may not be available to all users,” which the court found sufficient warning to customers purchasing the game.
