Former Brockport Trustee, and dissolution spokesman, Dan Kuhn has been directed by Sweden police justice Mark Depferd to appear again in Sweden Town Court on an unspecified date in June.
The date was unspecified because the court calendar hasn’t been set yet for the June court date for Village code violations, parking tickets etc.
The case started back on August 31, 2011, when Kuhn was issued a Notice of Violation because of multiple code violations on his house at 34 Utica Street in Brockport.
According to the Notice of Violation:
- Kuhn’s house is in need of painting.
- The fence is in need of repair and painting.
- Electrical work needs to be done on the front lights.
The Notice of Violation had a compliance date of September 28, 2011. But Kuhn didn’t bother to respond to the Notice as required.
No one started scraping and priming the house. No one started to repair the broken shutters or the broken fence.
So Kuhn was issued an Appearance Ticket on December 30, 2011. It charged Kuhn with:
- Violation of Local Law 2 counts of exterior wall in need of repair.
- Violation of Local Law 1 count of lack of fence maintenance.
- Violation of NYS Property Maintenance Code requiring maintenance of exterior walls
- Violation of NYS Property Maintenance Code requiring repair of electrical issues
- Violation of Local Law non maintenance of Historical Property.
When he appeared in Sweden Town Court back on January 9, 2012 Kuhn was told to appear in court again on February 2nd, the next court date for Village code violations.
Kuhn’s defense is that he has hired a contractor to make the repairs. That’s a song many a landlord has been singing in Brockport for years without making any progress.
But so far he has not produced a copy of the contract, nor has any work been done on the exterior of his house, despite the fact that the entire autumn has passed, and the winter is almost half over.
To top things off, this winter has been so mild winter that other property owners have painted parts of the houses.
All eyes in Brockport are on the Brockway House to see if Dan Kuhn will do anything to maintain the house before his next court appearance in June.
Dan Kuhn is a lawyer, so he is almost certainly not poor. Wouldn’t repairing the house would be a lot less hassle than getting dragged into court three times in six months?
