While the entire Kardashian clan is celebrating the news that Kim Kardashian is pregnant with her first child, there is one person who may be less than thrilled. According to a new TMZ report released on Jan. 2, Kris Humphries may not be so thrilled with the news – not because he still loves his ex-wife, but because he is legally presumed the father under California law. According to the report, it doesn’t matter that Kanye West is biologically the father. Because the two are still legally married under California law, Kris Humphries is presumed to be the father of Kim Kardashian’s unborn baby.
According to the report, that means that Kris Humphries could go after custody of the child. Well, it may not be too easy, but apparently, Kris just has to claim he is the child’s father – because he is by law because they are still married. Kim Kardashian and Kanye West would then have to present “clear and convincing evidence” to a judge to explain why Kris isn’t the father. Surely, a blood test would prove that Kanye is the biological father. If that isn’t enough, the website predicts that the child was convinced when Kim and Kanye were in Rome three months ago, and that Kris hasn’t gone near Kim for a long time.
