Kim Kardashian and Kris Humphries marriage lasted 72 days, they have been legally separated for over a year, but California law makes the presumption that the husband of the pregnant woman is the father of her baby, TMZ reported on Wednesday, Jan. 2. Legally, Kim Kardashian is still married to Kris Humphries.
What does this mean for Kris Humphries? Kris now has the upper-hand in the divorce proceedings currently pending in California. Kim Kardashian filed for divorce on Oct. 31, 2011. Kris Humphries filed for an annulment of the marriage, saying that Kim married him under false pretenses, and that the marriage was done to garner ratings for the reality television show, “Keeping Up With the Kardashians.”
Kris Humphries could lay claim to Kim Kardashian’s baby with beaux Kayne West unless Kim and Kanye can present “clear and convincing evidence” to a judge that Kayne West is indeed the father of Kim’s baby. A simple DNA test would prove the baby’s paternity, but since Kim and Kris have not been near each other since they separated in October 2011, it should not be too difficult for “Kimye” to prove that Humphries is not the father of their baby.
