Kris Humphries is the father of Kim Kardashian and Kanye West's baby, according to California law – at least until paternity is proven otherwise. In a report dated Jan. 2, California law automatically presumes that the woman's legal husband is the baby's father.
TMZ also reported on Jan. 2 that it would be easy to prove that Kris Humphries is not the father of Kimye. Kim Kardashian and Kris Humphries have been separated for over a year. She and Kris Humphries haven't been close to each other in quite a while.
“There are several states that makes the same presumption,” Lisa Anderson, from Oklahoma City, said. “I have known men who sped up their divorces by threatening to claim a child they knew wasn't theirs just to get the divorces settled.”
Kim Kardashian and Kanye West would have to prove the Kanye is the father, should Kris Humphries claim he is Kimye's father. It has been reported that Kim Kardashian is 12 week pregnant. That puts Kimye's conception in Italy, far away from Kris Humphies.
At the time of publication, it was unknown if Kris Humphries is considering claiming Kimye in hopes of a better divorce settlement. It is possible for Kris Humphries to use this California law in his favor.
