Kim Kardashian will not have to face Kris Humphries in divorce court (Photos)

Kim Kardashian and Kris Humphries were only married for 72 days when Kim filed for divorce from the Brooklyn Nets forward. Humphries’s will have his day in court, but Kardashian will not have to be there, just yet.

On April 3 TMZ reported that Kardashian’s lawyer filed legal documents requesting that the judge move the trial date up to May 3 because Kardashian will be in New York City to promote her perfume line on May 6 when the divorce trial is set to begin. The request was denied due to a conflict in the judge’s schedule.

Since Humphries has requested an annulment based on fraud he has the burden of proof in the case. Humphries’ witnesses will be called on day one. Kardashian will not need to be in court to address the charges of fraud until day two or three of the divorce proceedings.

Kardashian is pregnant with Kanye West’s child and is expected to give birth sometime in early July. There has been some confusion as to whether Humphries could lay claim to Kardashian’s baby since the couple is still legally married and the law provides that the woman’s husband is presumed the legal father of her baby. However, California law states that a couple must be cohabiting in order for the husband to be presumed the father. Therefore, Humphries will have no claim to "Kimye’s" baby.
