Kim Kardashian is pregnant with Kanye West's baby -- but her soon-to-be ex-husband, Kris Humphries, could be presumed father according to the law. Why? Because the two are still technically married. On Jan. 2, TMZ reported that Humphries could claim the child as his own in court.
"In the eyes of the state's Family Code, Kardashian's estranged husband, Kris Humphries, is presumed to be the father of her baby because the two are still legally married," TMZ reported. However, according to an attorney, this actually isn't the case at all. ExtraTV confirmed that the law only applies to married couples who are "living together [and] cohabitating in legal terms."
Kim Kardashian confirmed that she was pregnant less than a week ago and while no one doubts that Kanye West is the father of her child, there could have been a major snag in her divorce proceedings. However, it seems as though everything will work out just fine. Kim and Kris need to just hurry up and get divorced.
A simple DNA test would prevent Humphries from laying claim to the child anyway, so it's not like he'd really fight for it. It is unknown if he has plans to further prolong the divorce or if he's ready to let it all go and just move on with his life.
