A controversial case. A Kansas man, William Marotta donated his sperm by answering an ad in an online newspaper placed by a lesbian couple, he would be paid fifty dollars. Marotta and his wife agreed they would not accept payment and would just be doing it to help another couple the family they wanted. The state is trying to make him pay child support now. The man signed an agreement voiding him or all financial responsibility or parental rights at the start.
The couple has broken up and the single mother of the child had to apply for benefits
The case hinges on the fact that no doctor was used to inseminate the mother. A supreme court ruling in Kansas orders a doctor must be used to inseminate the mother, for a sperm donor to not be considered a father. The man dropped off the sperm donation at their home and the two women inseminated the sperm themselves. The mother became pregnant with a little girl. The state of Kansas argues that is why it is the law to go through a doctor to keep these kinds of events from happening. When a mother applies for benefits from the state is common practice and state law decide paternity and to go after the father to repay the public assistance, which now totals $6000, to lessen the cost to taxpayers.
Angela Bauer and Jennifer Schreiner placed the ad
Saying they were seeking a sperm donor the couple exchanged numerous emails with Marotta. The three set up a meeting at which they signed an agreement waiving Marotta of all responsibility. After the couple became pregnant they broke up. Shreiner received public assistance for the little girl.
The State Department of Families and Children filed a court petition against Marotta in October 2012
Marotta asked that the case be dismissed stating he is not the child’s father but just a sperm donor. Marotta is worried about his financial situation. The court shows a financial agreement was signed by the couple and Marotta, “holding him harmless” in 2009. The agreement also does not list Marotta’s name as the father, according to the agreement. Marotta has no visitation or parental rights as a sperm donor according to this agreement.
Marotta and his wife were on the Today morning news show, “this is not at all what we had signed up for.” The battle ensues. Can the state enforce Marotta to pay child support?
