Kandi Burruss sues Kim Zolciak over use of ‘Don’t Be Tardy For The Party’ (Photos)

Kandi Burruss, one of “The Real Housewives of Atlanta” cast, has filed a lawsuit against former friend and “RHOA” co-star Kim Zolciak over the song “Don’t Be Tardy For The Party,” claiming copyright infringement.

According to The Dish by Bravo blog on March 22, Kim Zolciak is fighting back through her representatives, alleging that the lawsuit is “a publicity stunt” for Burruss’ Bravo reality show “The Kandi Factory.”

Kandi, who also has a line of adult sex toys called “Bedroom Kandi” is represented by another “RHOA” cast member, Phaedra Parks, who is an entertainment attorney. In court documents filed earlier this month, Burruss claims that Zolciak unlawfully licensed, distributed, and sold the song.

Kim Zolciak claims that her teenage daughter Brielle helped “originate the song." Kim claims that Brielle is the one who is "getting lost in all of this. “Kim’s representatives admit that the song was originally a country tune that was changed by Kandi, who signed on to “revamp it.”

Zolciak’s representative also says that Burruss was paid more than $23,000 for the song, “Don’t Be Tardy For The Party.” Zolciak claims there is no merit to the case, and that the public perception is that Kandi and her co-writer were paid nothing for the song.

Kim and husband Kroy Biermann, a defensive end for the Atlanta Falcons, will star in their own reality show, “Don’t Be Tardy…” produced by Bravo. It is not yet known if the Burruss lawsuit will affect the name of Zolciak’s Bravo reality show.
