Judge rules two women and man are a family

A family court judge in Miami ruled today that two lesbians, already in a same-sex marriage, and the father of their child make up a family, giving all three parental rights over the child. The CBS story reports that a gay man donated sperm so one of the women could carry the child to birth.

The attorney who represented that man, the father of the child, Karyn J. Begin, said, “We're creating entirely new concepts of families, If you have two women seeking to be listed as Parent One and Parent Two, that does not exclude listing a man as father.”

The two women were married in Connecticut and later decided to have a child but were unsuccessful after several attempts via fertility clinics. The future father initially agreed to donate sperm but later in the pregnancy suggested he would help raise the child and be an active father. The women asked him to sign an agreement giving up all rights to the child, which was refused, leading to the paternity suit that was ruled on by Miami-Dade Circuit Judge Antonio Marin today.

The attorney for the father cited this case as creating “entirely new concepts” of families. Activists who wish to redefine a family, from the traditional concept one a married couple of one man and one woman having children, have sought acceptance of other definitions including same-sex parents or arrangements that include one man having multiple wives or a woman having multiple husbands, or other variations of multiple numbers of men and women being considered a family. Those who seek to change the definition of family support and welcome the decision by the Miami judge.
