Like any married couple, each parent wants custody of the children, or in this case, the family pet. At this time, Johnny and Victor have agreed to share the custody of Tema. The divorcing couple has decided that Victor can take care of Tema for one week each month. He will also get Tema anytime Johnny has to leave town, if it's longer than two days.

Earlier this week, Johnny had a court order that allowed him to take his personal things out of the couple’s apartment. Johnny and six police officers, along with Victor’s cousin went into the apartment to remove Johnny's things while Victor was in court. Victor arrived at the apartment just as Johnny took Tema. A sobbing Victor called his crisis manager, Wendy Feldman to tell her what happened.

Johnny alleges that Victor abused the dog. He said that Victor struck Tema with force several times after they were married.
