The man who admitted to injected SDSU student, Donna Jou, with a drug and then dumping her body into the ocean the next morning, when he found she was dead, will be released from prison on Friday.
John Steve Burgess was found guilty of involuntary manslaughter and sentenced to five years in prison will be released this week after serving two years.
Reza Joe, the father of Donna Joe told 10 News that he received a letter from the California Institution for men in Chino telling him that Burgess would be released earlier because of good behavior.
"That's their reasoning, good behavior, which I have a very difficult time digesting their reasoning," said Jou.
According to court documents, in 2007, Donna placed an ad on Craiglist as a math tutor. According to Burgess he answered the ad and Donna and him because friends. She came to his house in LA for a party and he injected her with drugs, resulting in her death. He said when he found her dead the next morning, he panicked.
Under a plea agreement Burgess admitted to dumping Donna's body in the ocean, which resulted in the sentence of five years for involuntary manslaughter and one misdemeanor count of concealment of an accidental death.
Burgess had been arrested and had prior convictions before the manslaughter charge.
2002 - 3 Battery convictions
Conviction & 146 day sentence - committing a lewd act on a girl younger than 14- Burgess has to register as a sex offender.
2005 - Arrest - beating up an ex-girlfriend
2006 - Burgess neglects to re-register as a sex offender.
After the trial, the Jou family sent a letter, written by Gloria Allred, to Craigslist.com to ask them to stop convicted sexual offenders from using their website. Craigslist never responded.
The Jou family are planning a protest for Friday, the day that Burgess is to be released from jail.
Donna's body has never been found.
