On Monday, many grisly details of what happened on the night of Dark Knight Rises massacre in Aurora, Colorodo could be presented in a court at a preliminary hearing for the shooting suspect, James Holmes.
Holmes' preliminary hearing is set to start Monday, Jan. 6 and expected to last through the entire week. The prosecution is expected to present recordings of 911 calls and approximately 30 hours of video from inside the Century 16 multiplex.
James Holmes, 25, is facing 166 charges in total including murder, attempted murder and weapons offenses.
The prosecution will put forth an outline of the events that happened on July 20 when he entered the movie theater and opened fire, killing 12 and injuring over 50 more. Prosecutors also call witnesses, including victims, to testify what they saw happen.
In response, the defense will argue he has "diminished capacity,"which according to the Colorado Bar Association, means:
When a client’s capacity to make adequately considered decisions in connection with a representation is diminished, whether because of minority, mental impairment or for some other reason, the lawyer shall, as far as reasonably possible, maintain a normal client-lawyer relationship with the client.
The LA Times says that many victims and victims' families will not attend, because of the pain it may bring them.
Last month, Cinemark, the corporate office of Century 16, sent a letter inviting all those involved in the July shooting to the reopening of the theater, sparking an outrage of victims families, claiming it was "too soon" and "inconsiderate".
