The James Holmes' defense versus Fox reporter Jana Winter battle has escalated since the dust-up over the prosecution tattling on the defense over the letter sent to the defense by Jana Winter's attorney. In the register of actions just released (pdf) it was revealed that a subpoena duces tecum has been noted instead of the earlier note which just had an ordinary subpoena issued. A subpoena duces tecum means the witness must appear with documents. Jana Winter has not responded to my inquiry asking if the defense is now after her emails. She also still hasn't responded to whether she had ever emailed the defense or given her cell phone number to them long before the dust up which if the defense would have contacted her directly would have saved the taxpayers money.
The only way James Holmes could get released is if the defense shows prosecutorial misconduct in which the prosecution leaked evidence and lied about it or however unlikely show his Korean contacts recruited him to develop and deploy bioweapon in their ongoing war against the United States. North Korean government has not responded to my inquiry.
