Is Casey Anthony's family trying to build a reasonable doubt case?
Is her first attorney at the heart of what amounts to a conspiracy to obstruct justice by carefully constructing, while at the same time giving instructions to family members on how to build a reasonable doubt defense?

If you look at her conduct in the month prior the family reporting that Caylee was missing, it’s hard to understand or swallow Casey’s claim that some phantom babysitter kidnapped Caylee.

First you start with her deplorable conduct, then comes the whole impossible to swallow or believe  kidnapping. Next she starts lying to the police about working?  Along comes the decomposition, followed by her unexplainable Internet searches. Now before long a case that is in part circumstantial evidence starts firming up for the 1st degree murder of "the little brat," as Casey described Caylee in her own words.

But this is not a strictly circumstantial case by any means. The defense wants to wish away the physical evidence by trying to pooh-pooh it as being inconclusive, it doesn’t work like that counselor. 

But, counselor you will get a chance to attack it in court, like the law allows.

When a defense attorney starts throwing up smoke screens with frivolous motions attacking the case in the media before the trial begins it is the attorney’s attempt to plant the idea in the jury pools minds that poor Casey is being railroaded.

It’s a text book defense strategy 101, but it can backfire and burn the client.  The judge will only put up with so many baseless motions then you’ll get a judge that is predisposed to send the defense attorney back to their chairs very unhappy throughout the trial.

It’s possible that when an attorney has a client that they know is guilty as sin, they have to pull out every stop in an attempt to get lucky and derail the prosecution, it works very well sometimes.  

The OJ Simpson dream team tossed it all up against the wall and hoped a few things would stick. Guess what it worked rather well. The overmatched prosecution team were so out gunned.

The prosecutors in the OJ case walked into every trap the defense laid and each time the landmine blew up in their face. But at the end of the day they all got their book deals, as they will in this case, win or lose.

When the client is guilty as sin an attorney will do anything they can to go after that one or two jurors that they can hang the jury with.

They only have too hang the jury on average twice and the case goes away because the prosecutor is afraid they will be seen as pushing a vendetta against the poor girl.

One strategy you can’t rule out is: lets go ahead and anger the judge, it’s more likely the judge will make a mistake if they are angry. If the they get made and make blunder they have reversible error for an appeal to get a new trial.
 

The more times they can get a case retried the better the odds of the defense winning.
 

There is more evidence but with not being directly involved in the case it forces you to wait until the trial (s), for the prosecution to present all their evidence in court.

It’s easy to prejudge her and say she looks guilty as hell! Proving that in a court of law beyond a reasonable doubt is another kettle of fish I’m afraid.

Here is where the case starts getting interesting. Most attorneys will shut their client down immediately, having them exercise their right to remain silent, not in this case.

Casey’s lawyer let her blab on and on using the jail phone. He knew those phones were being recorded. When you analyze all of the statements made, by mommy dearest(AKA Casey), her mother, father, and brother you come away saying what exactly is going on?  
 

OK the mom is a little off kilter maybe she had some involvement with her daughter?

Then you're listen to the brother that seems to be helping the police, but before they're finished talking you're shaking your head going wait a minute did he do something?

Next it's daddy's turn to have a break down, word is leaked about a possible suicide attempt. Wow, suddenly you start going is he involved in some way that he’s acting out of guilt?

Answer “yes,” they’re all involved, not in the murder, but in the attempt to muddy the water so much that a jury goes "well I don't know it seems like reasonable doubt to me!"
That is exactly what is going on here, the person driving the engine from day one has been her first attorney. Can it be called an effective defensive strategy? Absolutely,  but can it be also called a conspiracy to obstruct justice?

It may very well be, that at some point the prosecutor may say "I think it's time we charged the whole darn bunch of you, including you Mr. attorney with a conspiracy to obstruct justice."
 

It’s easy to see parents wanting to protect their only daughter. But protect her from justice in the brutal murder of your own grand-daughter you profess to love so much?

Lie through your teeth to obstruct justice in an attempt to secure your daughters freedom?
 

So as the world the turns in the soap opera that is the Casey Anthony show!

    Love your take on this crazy case!

    Am wondering about the "book deals." I thought that the only way attorneys could profit from book deals is if they get an acquittal for their clients. I think if the defendant is found guilty, neither the defendant nor the attorney(s) may profit.

    The way you've interpreted this cases legal news and added your opinion would suggest you're still sharp and thinking for yourself - provoking others to do the same. That's more than many people can say they've done throughout their lives. Great piece on such a chaotic, confusing and tragic trial.

    Those dice are obviously still rolling and long live the free thinkers.

    Zippity, I'm not sure to be honest with you. The defendant can not profit if she loses. I don't believe I've ever seen anything about her attorney not being able to profit. Often attorney will take cases and the client signs over book rights and movie right to the attorney for payment for defending them. I the OJ case I don't think was a person associated with case that didn't write a book.Some of his attorney's, both of the prosecutors, witnesses you name it. So I was pointing it out more in jest than anything else, but trust their will be some books and likely a movie about this tragic case. Thanks for your comment.

    I am hoping that everyone on the prosecution side has learned a few things since the o.j. trial & have vowed not to let anything like that happen again. I do agree that the family members are doing whatever it takes to prove doubt. I pray that the tot mom gets what she deserves along with the rest of the bunch. you are doing a wonderful job on reporting, keep up the good work. hope you get to go to florida when the trial starts.

    Shawn, thank you, this case has reached all the way across the country and grabbed a lot of us. Sadly it reminded me a great deal of a case I worked many years ago. Cases involving children are hard to forget.
    I understand it is a lawyer job to give their client the best defense. It's not a lawyers job to mastermind a conspiracy.

    Leslie, Thank you for your kind words. This cases are so heart breaking, I believe in my heart justice will prevail. It's not been that many years ago back when I was young police officer that children had almost no rights and little protection. You were lucky if you could get parent that killed their child into jail for a year. Any many cases you couldn't get the prosecutor to even file. I don't want to think of how many shaken baby cases were kissed off to SIDS. So we are headed in the right direction to a place where people may realize don't hurt the baby's and children.

    This conduct by the attorney and family needs to be prosecuted for an example to the people. They have made a JOKE about our justice system and belittled the crime of murdering children. Geeorge's comment " I never knew garbage could smell so bad..." comes to mind....for god sakes people, he was refferring to his dead granddaughter.....IF THATS NOT SICK, I DO NOT KNOW WHAT IS....?????? Please state of Florida, make examples out of these freak jobs so that it does not pave way to more children being discarded by their families...

    I think there is a likely hood of a possible hung jury. This case has so many twists and turns. Of course the Anthony's are going to protect their daughter. Casey is all they have left. Caylee is gone, so why not save the only thing left that they love? I know that if she ever gets lucky enough to win this trial and go home, that Orlando will not tolerate it. They would kill Casey or torch her house. There is no way in hell those crazy protesters would let Casey back in their neighborhood. Poor George and Cindy seem to be so brain washed by Casey, and I think it's too much for them to conceive. Nobody want's to think their only daughter is a baby killer. I used to think Casey wasn't the "trigger" man in her daughters death, but now I have some serious doubts. I hope they are able to find a jury that hasn't heard of this case or else their in trouble because the majority of America thinks Casey did it. In my eyes, everyone has already judged her and that's not good on her behalf.

    God, I hope that baby killer gets convicted. SINdy and Georgette have gone on a national media tour for the sole purpose to create reasonable doubt and get their baby killing daughter off. If there is truly justice in this country, she will get convicted. But if this baby killer walks, I give up with the justice in this country. If she does walk, she will be harrassed for the rest of her life and she and her parents will definitely have to move out of the Orlando area or Florida more preferably. But knowing how obnoxious and arrogant the whole Anthony family is, I wouldn't be surprised if they refuse to move out of the area, and stay just to irritate the Hell out of the rest of the Floridians. Of course they will have the bigger house and yard, SINdy and Georgette seem to have no problem spending blood money. In the very beginning they even got Caylee Marie Anthony's name copyrighted, for Christ's sake. They have got dollar signs for pupils in that family for sure. Disgusting!!!

    An Osceola County man, who was accused of murder, walked out of court a free man last Monday. In court, the state argued Contreras had been thrown out of a Kissimmee bar, returned with a gun and shot the owner. The prosecution had eight eyewitnesses. His lawyer was Jose Baez. According to Baez, if the state wants to convict his clients, they will have to work harder than they ever have before So now I ask, how bad is Mr. Baez as an Attorney?!?!

    RAZZY, don't hold back tell us what you really think, I'm just kidding great comment I couldn't agree more. I'm trying so very hard to remain objective but I'm honest enough to admit it very hard.
    If she innocent than she did every possible thing she could do to make herself look guilty!
    The way I feel about this case right now I would have to be disqualified if I were selected as a member of the jury. The evidence is there, this is not a who done it case! In my mind the big question is was mommy involved in helping to dispose of any evidence?

    thanks for your comment. Each case is different, often you are better off not having eyewitnesses. That may sound strange but no two people see an incident exactly the same. A smart attorney can use that to confuse the heck out of a jury. This case is part circumstantial, part physical evidence. Also another part that will come in and be important or the Race-Gesti statements made by Casey. Race-Gesti may be spelled incorrectly but it basically means unsolicited statements and their are bunch of those. I really didn't mean he was stupid, he just pulls some stupid moves to muddy up the water. It's part of his stick, I believe he may cross the line and commits crimes to get his clients off.

    Great article!!! This is my first time reading your column!! I also have been wondering why a gag order has not been placed on this case. Maybe Florida cases cannot be "gagged?" I just can't believe that the judge is allowing all of this. The defense complains that the case is being tried in the media, yet they are one of the worst offenders when it comes to getting media attention. I suppose that even with a gag order, it's not possible to limit the media from reporting things like Geaoge's "suicide" attempt. I hope that you are feeling better and, again, great article!!!

    Janet a tight Gag order should have been placed on this case in first place, a muzzle would likely be needed. It's a circus and it's gotten so since the OJ case every judge wants to be a superstar on court TV. In this case and the Drew Peterson case a Ring Master would be better suited than a judge to handle all of the high-wire work, juggling and family and suspect clowning around.

    CAROL, thank you, you can contact as can anyone at doylewheeler@yahoo.com I might take you up on your offer once in awhile I would never as anyone to help with ll of them because I up to ten a day some times. Between local and national cases i stay pretty busy, but it's sure helping recover.
    One of the other problems is my articles have to post sometimes when it not convenient for someone to edit. Anyway i know it a problem for some of my readers and some don't come back. However so many people are very understanding at hat has been a blessing. I really don't mind t all when they point out something it helps me give everyone a better product. The problem is that my mind doesn't want to retain certain things can't explain it.
    Head trauma I'm lucky to be here so I do get to bothered by some people remarks. A few have actually offended but not many.

    Hey Kim you need to start writing for the examiner. Any subject you fell passionate about.You have an ability to deliveer your message in a very clear and concise manner. That smack down you just delivered was awesome.
    I don't mind Erin disagreeing with me, I just wish she wouldn't hit and run. State her case so we could understand what she talking about, rather than dropping by leaving a couple of weak insults and dashing out the door.

    . Thank you Mr. Doyle, I do get lucky once in a while where words just fly from my fingertips, I have thought about it many times. I guess I just can't get past my fear of comittment (or my inability to spell) Writing, like any craft requires commitment. You were right when you said that it is healing. (not your exact words but clearly your message) I do enjoy it as a hobby, but I really don't think I have what it takes. You have the talent and the perserverence to drive you. this may be what is healing for you. Keep up the great work! I really enjoy reading your articles...typos and all! chuckle

    Doyle, you are amazing. Had you not told us I wouldn't have known you had a stroke. Very happy you are on the mend and doing well..

    As far as the Anthony family and Baez trying to create this doubt. I say the more they do, the more guilty casey appears. They have tried this from August on when they created their false Caylee sightings. They knew it then and the know know, Casey and only Casey is responsible for Caylee's demise. Let them keep on for Casey will never be a free woman...

    Thank you very much. My heart tell me she's guilty my mind says wait for all the evidence, my experience tells me to never anticipate what a jury might do. A lot depends on the skill of the prosecutors, the delivery of expert witnesses, the skill of the defense attorney, sadly a lot depends on who delivers the most theatrical performance. It shouldn't be that way but attorney's have to be good actors. Most good defense attorney win not because the evidence is weak, but because the prosecutors performance was weak. I pray it all works out.

    Great article ! While i respect that it is an attorney's obligation to provide the best possible defense for a client, "conspiracy to obstruct justice" is crossing both legal and ethical lines. This behavior can seriously hinder the pursuit of justice for victims and needs to be deterred through negative consequence so that a true model of justice can be maintained. Particularly in widely publicized cases like this where lawyers may be more motivated to 'win' because the rewards are great both finacially and in terms of public notoriety. This potentially illegal activity should be considered carefully, investigated and if proven, reap legal repurcussions for all involved.
    The resulting consequences of this examination, either positive or negative, can have far reaching impact on the evolving system of justice and the public trust in that system.

    You nailed it, this guy has stepped so far across the line. You have a right even an obligation to give your client the best defense. But exactly what I've been saying conspiracy is going to far. If this is allowed to stand it will undermined the criminal justice system and have ten times the negative effect the OJ case had. Great read on your part on the dangers this case presents.     Hope you are recovering Doyle. Your article shows no signs of diminished capacity, and I hope you're feeling 100% soon. When is this trial going to happen??! Between Casey and Drew Peterson, there's at least 3 victims and no conviction. Why is it taking so long to bring these two to justice?

    As for these cases they both slated for trial in 2011, now that doesn't mean they will get. The defense is usually the deciding factor in how long it takes.
    The prosecution has to be ready to go pretty fast because if the defense request a fast track trial, which they seldom do.
    But the accused is entitled to a speedy trial by law.
    The defense usually waives this right as they want all the time in the world to get the focus off their baby killer, I mean client. They always hope critical evidence will disappear, expert s or witnesses will die, They also need time for their expert witnesses to draft their paid for fair-tails. Most of time hookers on street corners are more honest and objective that defense experts who are also paid whores.
    Now Jose wants to keep the whole $250,000 so he has do enough billing hours to justify it. In his case he needs the time to attack innocent people try to raise any doubt.
