"simply been uncomfortable exposing himself completely and arranging himself in a way that gave a passer-by the wrong impression."
According to a report from S.F. Gate, on Nov. 11 a man was walking his dog when he noticed Sierra masturbating in public on Castro Street.
Sierra, who is being described as an inexperienced and self-conscious nudist, wasn't masturbating he just wasn't fully comfortable getting totally nude because of the scars on his stomach, said the defense. Deputy Public Defender Cindy Elias said,
"He pulled his pants down to his knees and then attempted to attach his shirt to his genitals using a binder ring, according to defense attorneys. While arranging his clothing, however, a passerby thought he was masturbating with personal lubricant and contacted police, who arrested him, said defense attorneys."
The defense insisted that the witness misunderstood Sierra's movements and Sierra says he didn't have any lubricant on his person. The lubricant the man claims he saw was really prescription eczema cream, Sierra stated.
After the jury heard both sides of the story, it took only one day before returning the verdict. The inexperienced nudist was acquitted of charges that could have gave him a year sentence in jail and he would have been ordered to register as sex offender.
Public Defender Jeff Adachi said in a statement,
"Mr. Sierra's failed attempt at being a nudist certainly does not warrant lifetime registration as a sex offender."
