Hulk Hogan has refiled the $100 million dollar suit against Gawker (TMZ Jan 3) after dropping the federal suit last month. The wrestler dropped the case in order to refile in Florida where his case against Heather Clem has been filed. Clem, the ex wife of Hogan's former BFF Bubba The Love Sponge. She is accused of being partly responsible for leaking the 1 minute long sex tape that she participated in.
Hogan claims no knowledge that the encounter with Clem was recorded six years ago. After he was seen leaving the room, Bubba appeared on video and can be heard saying "If we ever did want to retire, all we'd have to do is use this footage." Hogan previously filed a suit against Bubba as well but that case has since been settled and the radio personality apologized for his part on air.
In the original suit, Hogan claims he "had a reasonable expectation of privacy in his consensual, intimate activities in a private bedroom and reasonably believed that his privacy was safe and protected."
The website Gawker claimed they had the journalistic right to publish the tape and that the damage had already been done to The Hulkster's reputation long before they had entered the picture. Besides, they didn't film the escapade so they weren't the ones to invade the TV personalty's privacy.
