Approximately a year ago the County of San Diego initiated a child support case against me for one of our children and one against my wife for our other child. To give you a little background, 14 months ago our children ages six months and two years were removed from our custody for emotional abuse. The details of this case are the subject of several past and future articles.
The County of San Diego receives approximately $4,000 per month per child in the form of federal Title IV social security funds for each child in the custody of Child Protective Services. From the $4,000 the County pays approximately $600 per child to the foster care provider the child is placed with. Regardless of the fact that the County receives federal social security money to cover the cost associated with foster care placement, the County interprets this payment as a loss and opens a child support action against the parents to recoup the $600 under the welfare reclamation clause. Once a child support order against the parents is granted, the County receives approximately $2.40 for every $1.00 of child support collected in the form of, yep you guessed it, federal Title IV social security funds.
Is it just me or does anyone else see a problem with this system? I think it is very clear that the county is triple dipping. As a matter of fact, I think it is so clear that I decided I was going to use my child support case to expose this corruption.
A few months ago I began submitting Freedom of Information Act requests and California Public Record Act requests to compile the information I would need to expose the corruption. I submitted multiple requests seeking multiple items. A good number of the actual requests and the responses I received can be found on www.crispe.org/forum
One of the contacts I have been working with is Senior County Counsel for the County of San Diego. Last week I sat down and met County Council at the County administration building. During our meeting I explained in detail my plan to expose the corruption in the county and explained exactly the information I was seeking. I also informed County Council that I would be utilizing the discovery process in court to obtain the information I could not obtain from him.
Now, this is where it gets interesting, today I received a phone call from a lady at the Department of Child Support Services. I was informed that an ex parte hearing was set to take place on December 2nd 2009 at 08:30 in Department 42. The purpose of the hearing is that the County suddenly wishes to have the child support action against me dismissed. I inquired as to why the county would seek dismissal and I was told “because there is good cause”
My question is this, is the term “good cause” synonymous with the term “our butt is about to be in a sling” I know many people in exactly the same situation as myself but none of their cases were dismissed. Over the past year nothing has changed in my case. I am doing nothing different now that I haven’t been doing all along. The only thing that happened was that I told the County my plan and that I know what information I need to support my allegations and that I know where to get it.
I will be going to court on Wednesday. I will let everyone know how it turns out. I am actually considering objecting to the dismissal of the case, but we will see.

If we could ever pull the lid off this festering Organized Crime ring, it could be the story of the century. Or perhaps second only to the Global Warming fraud.
We hear about a Class Action against CPS every once in a while, and we yearn for the day that this insane system is sued out of existence for TRILLIONS in damages to America's Families and the system actors imprisoned.

If they dismiss, does that give you grounds to sue for malicious prosecution, or something like that?
I bet people would be willing to give you something like six months of what they were paying for child support in exchange for your help in preparing a case to get it dismissed. Start getting people's child support dismissed and everyone wins. Cut the beast's financial throat!
I am with Leonard and in agreement to when the light shines, they run. Every family court case has a dark lining to it, it is called CPS. They lie, cheat and steal from Americans , if not from the federal funding that comes from the americans , they steal from us the other way by making our suffering pay their paychecks, there is triple dipping all the way around. In my case , there is 1400 dollars missing and has not yet been returned.

wow that is great .....sorta my drivers license is suspended because I refuse to give them one dime for stealing my kids. I was told I could make a minimum payment of 10$ and get my license back- hell no they will not get a dime from me. I have nothing in my name, no bank account no home even though I own one now, any checks or money I have made out to my husband whom I married after my case so they have no way of attaching anything. I never answered their monthly statements they have no way of knowing that I am aware of the bill. I thought about writing them and telling them what I really think about their monthly statements- but that would then inform them I had received those. Can't wait to hear what happens in court

This message is to XTREME Greg and everyone on this group I have had settlements stolen bank accounts taken checks and benefits taken and back taxes taken for a child that isnt mine and I didnt adopt and she has a BIO dad that isnt being persued for his share they are comming after me and I am totally disabled and make less than their order is demanding I pay per week and month and there is no actual paperwork that we can find out where all the money went that they stole from my wife and I.I cannot work and they are threatening to take everything I own and sell it at a State auction for pennies on the dollar as punishment to put towards what they claim I owe And that is just the beginning with this one.They claim if they take everything I own cps will take my 2 children because I wont have the necessitys to house and raise my 2 children isnt that sickning Somedays it is hard to get any sleep because they say they are coming soon to take all I own

Bitter sweet dirty ending. You will be granted dismissal in exchange for you to STOP pursuing exposure of their corruption. My case in NC was sooo obviously mishandled but DSS preys on ignorance. If we could get everyone or orgs who know of the crimal acts DSS is allowed to get away with i.e. abduct children and degrade and dismantle families, challenge these county social service agencies with FEDERAL support, we may one day have family preservation and end slavery. The prob is, the county, state and fed gov are all in bed together. So, one would ask, who is there to help us?

As for CPS, it is the most filthy, corrupt, evil gang of perverts walking the face of this earth. The insanity of kidnapping your children and then forcing you to pay for them to be in foster hell. They are worse than criminals. They all deserve life in jail. Keep fighting, and contact all who might help - politicians, media, anyone and everyone you think might help. CPS is like a business, they have to keep expanding. But the very fact they have to expand will lead to their undoing, as they are targeting people who have the resources to fight back. Our Children were taken off the word of one family member. We gave them over 30 names of people to call. Not one was called. They took our children from a safe home and put them in the home of a man who likes to bathe his 12 yr old, adopted daughter. She screams at him to leave her alone every time he comes to get her to give her a bath.(no she isn't handicapped).
We wouldn't sign the paperwork with all the lies so we weren't allowed to see our children. We finally go a new CPS worker who told us that CPS had no legal right to take our children. Nor was there any order to keep us from seeing our children. Our children were home shortly after that with praises about our parenting. They now have health problems due to all the psycotropic drugs, but we were the problem. They have been beat up, drugged up, and spied on by the perveted old man they were living with. They are teenage girls and well developed. We have reported them and will see if anything at all happens. (yeah right!)

Great news So good to hear hard work and diligence really does pay off Justice seems to be prevailing even if it is so so slow you should be proud of your efforts!!
I'm a single mom taking care of my kids at home. I have a few more months until my liscence is suspended for nonpayment. I get social security and have no income. I qualify for welfare, have 5 kids in my custody I refuse to hop on the welfare wagon. I have 2 other kids who have been unjustly incarcerated sentenced for 10yrs, been kidnapped from me for over 3. If I apply for welfare I wouldnt be required to pay support but I hate DHS more than I hate being poor. I have 2 ex's that are on SSD that aren't required to pay support according to the CSD but I am. At first I was required to pay 0 cause I get SSD. I moved, they changed the order without notifying me. It racked up a few hundred $ in back payment. I want to be held responsible but fairly. They didn't even consider the money I spend on them and money I give them physically as child support. They want 1/5 of my SSD to be given for support. In Oregon not having a job isn't taken in consideration, $100 min job or no job!

Maybe I am dense, but I am in this same boat and cannot figure out what I need to do or what my next step is as far as this situation goes. I have a 16 year old that has been placed in state's custody but 3 others that stayed with us. She has been in custody since May. I was ordered to pay child support in the amount of $172.66 a month while I am working part time and supporting 3 more children on that income. The judge and DA both laughed when I told them I couldn't afford that on my income they told me that I was responsible for the oldest before the other 3. But if I pay the support to go without lights or water they can take my other 3. I am now 3 mos. behind as of Nov. 30 and they have ordered me to come back to court in January for a show cause at which time I will either be fined 500 dollars or do 6 mos in jail. My 5yr old was taken on Sep 8th 2009 and placed into foster care. I'am a single mother and have done my best to support the both of us. In Sept I made a decision to move in with my friend and her father so I could go back to college as this would lighten my financial load a great deal and get back on track with my bills nothing permanent just until I got back on my feet. Well because I did not report the fact that I was moving CPS kidnapped my child out of her Kindergarten class. Because of the stress and everything else that comes along with this terrible situation I lost my job of 3 yrs and now have just started my new job. They would like me to pay child support and my daughter will not be returned until I establish a place of my own. Which I'd like to mention that I can have a room mate but I can not be someone's room mate?????? How does this make sense? They are corrupt and have no common sense. I would like information on how to fight the child support act.

I live in NY. My 17yr old son is in foster on a court ordered PINS. I am expected to pay support yet I am on a fixed disability income and expected to continue to provide for my son who makes frequent home visits. I have 20 days to file objections to the court. We have four beutiful kids and cps has them all i think they have such a corrupt system the people that dont desire ther kids get to keep them but the parents that do desirve their kid dont get to keep them we were a wonderful mother and father and all they did was hurt my my children and not just ne.I lost my children purley because of a false report.many people survived 100's of yours without cps .do we think really need to waste all that taxt money on them
They use the support as leverage to keep your children they don't really care about the support for the children. I had two children and to this day I am still owed over 60,000 for both. Not once was there dad even threatened with losing his liscense. The last time we went to court was in 2000 I told them then he was never going to pay so they just let him leave the state. I told them I figured as much I give you permission to throw the bum in jail and you won't. I told them that his mother was rich and she would pay if they would throw him in jail but they refused. Now they are grown no thanks to daddy he never sent a birthday card or a Christmas card. I lived in the same house for 15 years and he had an open invitation to come visit. I wanted my children to know who their daddy was no matter what but he didn't want to know them I guess 3 visits in 19 years at 2 years old 30 minutes at 12 years old and then once at 14. My son got to see his dad one time at 5 never to see him again.

Thanks for sharing your story it's a sad fact of life the government lies to the people. Yes they do just ask any Indian! I refused to pay once I got on welfare due to health condition which is permanent. The Child Support Enforcement office dropped my case and went after my ex-husband. The CSE office has tacked on his tab an upwards of 10,000 dollars while mine was under 700 dollars before getting on Welfare. I never got my license back so if there is no license to take the joke is on them! I can't wait to hear what you have to say about court. My son is back with me because I finally got CPS to take notice because of allegations of physical and emotional abuse. I'm still the same person makes you wonder what's different now with me? A comment about the malpractice insurance for CPS social workers. DSHS is the most sued agency in Washington state. I read some where on the Internet that no one will ensure DSHS in America. They pay huge to an insurance company in the United Kingdom. What a riot!!
My husband and I had our children taken away in Jan 09 and we have did everything that the social worker had laided out in our "caseplan" and we got no help with our "caseplan" from her. We did everything ourselves. When we finished everything and the one thing that we had trouble with was getting her to set-up appointments between our oldest daughter and myself for therapy, it took her all the way until Oct 09 to set this up and the catch was that the therapist didn't even know that she was supposed to meet with me to start the sessions. I have it recorded on my phone and now I finally have a date to start this stuff. The only thing good in this case is my husband's attroney because she is only one doing her job. It can be possible to sue CPS, especially if the SUPERVISOR holds malpractice insurance or errors and omissions insurance.
Debra is absolutely correct when she says DSHS is the MOST SUED AGENCY IN Washington state.
Childrensrights.org, based in NY has stated they will take on some individual cases of FC mistreatment, etc.
Much of what DCS does is illegal, unaudited, and corrupt.

im very upset my 4 nieces who have adhd and one has bipolar too were taken away from my sister taira and my brother in law daniel on feburary 27th 2008 and they never did nothing wrong my mom and i lived next door to them when we use to live in carrollton tx and when my mom and i moved to mckinney tx july 1st 2007 the sameday my sister , her hubby and 4 girls moved to plano tx that was just about 15mins away from my mom and i so we was still really close and when my mom and sister was working at walmart i was baby sitting 2 of my nieces and alot of the times id stay in plano and help my brother in law take care of them and my nieces were never hurt at all tho people up stairs was always making false allegations saying my nieces was always outside by there self and nobody watching them which was a lie my brother in law was outside on the patio and id be at the playground with them and please contact me irishmomma31@yahoo.com

i still cry alot they robbed my sister and my brother in law and my mom and i of the four girls missing there birthdays and christmas all the holidays i was really crying on christmas eve and christmas not to mention happy new years jan 1st 2010 i feel like they should only be with there real family not with people they bearly even know , i miss fixing up my nieces hair and making them look cute for school and pictures and knowing i havent got to do that for over 2 years now its already 2010 i just hope god brings them back home soon to us again the only higher judge is are heavenly father from above not these court judges anyways

Loved your story!! My story is somewhat similar!! My oldest daughter(now 17) from a previous relationship decided that it would be best for her to go inot foster care. While at the first foster home she came out with some wild lies (and has admitted to some of them as lies since). My husband and I decided to "let her go for now" and concentrate on raising our 2 younger children (7&9) that we had together. The problem now is that Social Services in Colorado has decided that although I am paying child support for my daughter I have NO right to any info on her. They have also informed me that they are going to retain custody of her til she's 21. They have also decided that she should be allowed to have access to our younger children. My husband and I are against this but have been told that they will take it to the State Supreme Court if necessary. I am so tired of them and dont trust them any....adn so scared of losing my entire family.....any suggestions???
Our grandchildren were taken into foster care last July, our daughter got them back 10/30/2009, the first of December our granddaughter recanted her story to her counselor, the D.A. had the kids picked up Jan.7,2010, accused us of tampering with a witness, that we're doing harm to the kids, they've made our daughter pay child support, it started 02/01/2010, and the 7th of April will be three months since we've seen the kids. There's real corruption in Collin County texas. They put our grandsons on medications the first day they picked them up, they're 5 & 9.
Our granddaughter is twelve, she snuck around at the foster home and called us stating they threatened her and told them we didn't love or want them anymore. We miss them so much. Our daughter needs help on fighting the child support. Is there anything we can do to get the kids back?

Im happy to find out more information about DCSS. My case is very complexed as due to my child costody case my ex wife has refused to comply with all court orders and opened a DCSS case against me stating Im refusing to see my kids in reality I have been spending time daily, even have police records to prove it. she quit the military stating to the court on an emergency hearing that she was being invoulenteerly seperated when she actualy chose to separate at the end of her EOAS and move to Texas. I dont live in the United states and had made this very clear, I have even requested an audit for over payment of child support and for the child support to be based off of my income witch is unemployment from washington state were I was invouleerly separating due to my ex wifes aligation 15yrs. they still refuse to due and autidit, change of menue and base child support off of were my children physicaly reside and that is in texas that was also refuse. the bigest problem is that DCSS didnt even comply with the court orders as well.
