Good news for comedian Tracy Morgan

After being severely injured in a car crash, the former "30 Rock" actor has been discharged from the hospital after spending nearly 5 weeks in the hospital.

Tracy Morgan was driving home from a comedy gig when a Walmart truck, going well above the speed limit, crashed into his limo leaving fellow comedian James McNair (Jimmy Mack) dead and others severely injured. Morgan suffered from a broken nose, broken ribs and a broken leg. His assistant, Jeffrey Millea, and comedian Ardie Fuqua Jr. were, too, injured from the crash.

Spokesman Lewis Kay said that Tracy will be returning home and undergoing "an aggressive outpatient program."And Morgan made sure Kay relayed his gratitude for his fans during this difficult time. "He asked me to pass along his sincerest gratitude to everyone who has helped him get to this point."

The comedian, who was a regular on "Saturday Night Live" and a "30 Rock" cast member, and his lawyers sued Walmart this past Thursday for "negligence." Evidence is pointing towards the possibility that the Walmart driver, Kevin Roper, was almost at his drive time limit resulting in unsafe driving as it is thought that he was awake for more than 24 hours.

Walmart released a statement, “This has been a terrible tragedy. We wish Mr. Morgan, Mr. Fuqua Jr., and Mr. Millea full recoveries,” Walmart said. “Our thoughts continue to go out to them, their families and friends, as well as to the families and friends of everyone involved, including Mr. McNair who lost his life. We are deeply sorry that one of our trucks was involved.
