Gay sex ban India: Setback for civil rights, gay sex illegal in court decision

A gay sex ban in India is causing international outrage as a huge setback for civil rights, as the top court in India has made a decision to make gay sex illegal again. In their statement, the Supreme Court confirmed that Parliament is the only structure which has the right to change any laws regarding the criminalization of gay sex, overturning a lesser court’s decision, MSN News affirms this Wednesday afternoon, Dec. 11, 2013.

Word of the gay sex ban in India has sparked outcry from not only members of the Indian nation itself, but from all around the world. As the earth’s biggest democracy, the choice to make gay sex illegal and overturning the ruling from 2009 sets a poor example for the rest of the world in terms of gay rights, activists claim. In New Delhi, the highest court deleted a former section of the government’s penal code that dates back to the late 1800s, stating that the Delhi High Court did not have the legal right to make gay sex legal over four years ago.

Civil rights groups everywhere see this gay sex ban India tagline as a tremendous setback for not only gays and support groups everywhere, but in the political system of India as well. Expectations were not even made, as many people simply thought that the previous ruling would be approved, as India’s Supreme Court has made some very forward-thinking rulings in recent months.

"We see this as a betrayal of the very people the court is meant to defend and protect," said Arvind Narayan, one of the lawyers representing the consortium of gay rights groups in defense of the 2009 ruling. "In our understanding, the Supreme Court has always sided with those who have no rights."

The contention surrounding the gay sex ban India re-instatement comes under Section 377 of India's lawful penal code, which bans "sex against the order of nature", thought to mean homosexual sex, and can be punished with up to 10 years in jail.

The rule goes so far back, it summons memories of the days of British colonial rule in India.

"One would never expect the Supreme Court of India to make such a retrograde order, that is so against the trend internationally," said rights lawyer Colin Gonsalves."It's a terrible setback. This takes us back to the dark ages. This is a day of mourning for us in India."
