Gai Scott enters not guilty plea in shooting his uncle, Benzino

The Boston Globe, March 31, 2014, reports that Gai Scott entered a plea of not guilty to charges of armed assault with intent to murder his uncle, Benzino, when he appeared in court today with lawyer, Jon Ciraulo.

Gai said he is afraid of his uncle, Benzino. Gai allegedly was so afraid of his uncle that he bought a gun two days before the funeral procession of his grandmother. Then, on the day of the procession, he would not allow his wife or his child to ride in the car with him.

Gai admitted to police that he shot at the red SUV that Benzino was driving that day. According to a police report filed in court, Gai said, “I shot at him; I was in fear for my wife and a baby. He’s been threatening my life.”

Gai alleges that Benzino, whose real name is Raymond E. Scott, sent him threatening text messages. According to Gai, Benzino threatened to kill him and that's why he bought a gun.

State Trooper Robert M. Klimas wrote in his report, “Gai also stated that Raymond had been threatening to kill him for years. I asked Gai why Raymond wanted to harm him, and Gai stated that it stemmed from animosity and jealousy.”

According to Gai, he was following behind the hearse when his uncle pulled along beside him. He said that his uncle rolled down his window and asked Gai if he had a problem with him and then he threatened to kill Gai.

Gai said that Benzino reached down. When his hand came up, it was holding a gun. Gai grabbed a 9mm Walther pistol from his right hip holster and shot at his uncle. He fired until the gun ran out of bullets. He then pulled out a .45 caliber and shot that gun until it was empty. He had an extra magazine for his 9mm gun, so he loaded it. The Boston Globe does not say whether he shot the ammo from that magazine.

Benzino sustained a bullet to his arm, while another bullet grazed his back.

Gai can legally carry own a weapon. However, according to Benzino’s criminal and civil attorney, Martin K. Leppo, Benzino does not have a gun.

Gai was held pending a dangerousness hearing in the Plymouth District Court on Wednesday.
