In a letter (PDF) written by Fox news reporter Jana Winter's lawyer released March 19, 2013, it was alleged that “Mr. [James] Holmes' has taken actions designed to frustrate Ms. Winter's attempts to prosecute her appeal”. They go on to claim that Holmes' counsel delaying proceedings was “designed to … and will result in the substantive denial of Ms. Winter's right to appeal”.
Winter's lawyer doesn't give any proof and even gives the defense the benefit of the doubt that they might have reasons for the delay. He however didn't even clarify whether Winter had emailed the defense right after the shooting and therefore the defense had her email and cell phone number that she includes. The main contention of the defense is that they called the main line at Fox News and couldn't reach Jana Winter and that was the cause of the delay.
Jana Winter's lawyer also didn't state whether she was in New York or Colorado when she received the tip about the notebook that Holmes sent to his psychiatrist Fenton. New York has a substantially stronger shield law than Colorado.
