Foster Parents; Your Right to appeal?

Part 4 of 4

  In parts 1-3 we were just explaining the court processes here in the United States and the lack of due process in the case of foster parents being placed on the Child Abuse Registry without the appeal process, due process. When you do not agree with the outcome in any of the limited lower courts, you have a right to appeal, take it to a higher court to obtain, if you will, a second opinion.

We see that unless we appeal the decision made by the Administrative Inquiry and/or Hearingwe will not have the opportunity to obtain justice for ourselves as foster parents. The higher courts and/or juries listen to real facts, not hearsay or “he said-she said evidence”.

  • Your examiner has observed cases in which the foster parents were not informed of the appeal process or even that they had the right to appeal this decision.
  • Even offered what amounts to plea bargains of a lesser charge when they are totally and absolutely innocent of the charge.
  • They are offered a C.A.P. (Corrective Action Plan) asked to sign it because they are told the charges will go away if they do, and had no idea what they were signing in essences was a confession.

This is why we say; if you do not know your rights as a foster parent you do not have any. They will not tell you your rights.

In going over the appeal process which gives us access to our justice system we are teaching you the importance in exercising these rights. Now let us go over some of the things we have learned in this session;

  7. if you do not know your rights you have none.

Is it important for you to understand these things when you are a foster parent, absolutely.

You live in a glass house as a foster parent, it is vital to your protection that you are aware of the best ways to protect yourself, others residing in your home and yes, your foster children.

The best ways to do that; with a basic understanding of the court systems, legal protection that is offered.  No one expects you to become a lawyer, a paralegal, even an advocate like yours truly However reach out and seek knowledge.
