Charles Alexander Diez shot at Alan Ray Simons with a handgun, hitting the cyclist's helmet but narrowly missing his head. Diez was reportedly upset that Simons was riding a bicycle on a busy street with his child on the back. Diez was concerned for the child's safety. Simons was walking away when Diez fired.
Today, in an Asheville courtroom, Dietz entered a plea of guilty to assault with a deadly weapon with intent to kill. He was sentenced to 120 days in jail.
Diez was first charged with attempted murder, but the grand jury refused to indict him on that charge as it required the elements of premeditation and deliberation.

This is absolutely mind-boggling. Attempted murder gets four months?
he should get 10 years just for faulty logic: The former fireman was soooo thoughtfully concerned with the child's safety that he tried to shoot the kid's father in the head.
